99 relating to the dormancy of certain judgments.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 34.001(a) and (b), Civil Practice and
1212 Remedies Code, are amended to read as follows:
1313 (a) If a writ of execution is not issued or a receiver is not
1414 appointed under Section 31.002 within 10 years after the rendition
1515 of a judgment of a court of record or a justice court, the judgment
1616 is dormant and execution may not be issued on the judgment unless it
1717 is revived.
1818 (b) If a writ of execution is issued or a receiver is
1919 appointed under Section 31.002 within 10 years after rendition of a
2020 judgment but a second writ is not issued or a receiver is not
2121 appointed within 10 years after issuance of the first writ or
2222 appointment of that receiver, the judgment becomes dormant. A
2323 second writ may be issued or receiver appointed at any time within
2424 10 years after issuance of the first writ or receiver appointment.
2525 SECTION 2. (a) The change in law made by this Act applies
2626 only to a judgment that:
2727 (1) is not dormant on the effective date of this Act;
2828 and
2929 (2) was entered before, on, or after the effective
3030 date of this Act.
3131 (b) A judgment that is dormant on the effective date of this
3232 Act is governed by the law applicable to the judgment immediately
3333 before the effective date of this Act, and that law is continued in
3434 effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2023.
