66 AN ACT
77 relating to the days and hours during which the polls are open for
88 early voting by personal appearance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.004(d), Election Code, is amended to
1111 read as follows:
1212 (d) The [If early voting by personal appearance is required
1313 to be conducted for extended hours under Section 85.005(c) or for
1414 weekend hours under Section 85.006(e), the] registrar's office
1515 shall remain open for providing voter registration information
1616 during the [extended hours or weekend] hours that the main early
1717 voting polling place is open for voting.
1818 SECTION 2. Sections 85.001(a) and (e), Election Code, are
1919 amended to read as follows:
2020 (a) The period for early voting by personal appearance
2121 begins on the 17th day before election day and continues through the
2222 fourth day before election day, except as otherwise provided by
2323 this subchapter [section].
2424 (e) For an election held on the uniform election date in May
2525 and any resulting runoff election, the period for early voting by
2626 personal appearance begins on the 12th day before election day and
2727 continues through the fourth day before election day, except as
2828 otherwise provided by this subchapter.
2929 SECTION 3. Section 85.006, Election Code, is amended to
3030 read as follows:
3131 Sec. 85.006. EXTENDED VOTING [ON SATURDAY OR SUNDAY]. (a)
3232 Except as provided by Subsection (b), the authority ordering an
3333 election may order early voting by personal appearance at the main
3434 early voting polling place to be conducted:
3535 (1) on one or more Saturdays or Sundays during the
3636 early voting period; or
3737 (2) during an early voting period extended from the
3838 fourth day before election day for any number of consecutive days up
3939 to and including the day before election day.
4040 (b) In an election in which a county clerk is the early
4141 voting clerk under Section 83.002, only the early voting clerk may
4242 order extended voting [on a Saturday or Sunday]. The clerk must do
4343 so by written order.
4444 (c) Except as otherwise provided by this section, the [The]
4545 authority ordering extended voting [on a Saturday or Sunday] shall
4646 determine the hours during which voting is to be conducted.
4747 (d) The authority authorized to order extended early voting
4848 [on a Saturday or Sunday] under Subsection (a) or (b) shall order
4949 [the] voting on a Saturday or Sunday under the applicable
5050 subsection on receipt of a written request submitted by at least 15
5151 registered voters of the territory covered by the election. The
5252 request must be submitted in time to enable compliance with Section
5353 85.007. The authority is not required to order the voting on a
5454 particular date specified by the request but shall order the voting
5555 on at least one Saturday if a Saturday is requested and on at least
5656 one Sunday if a Sunday is requested.
5757 (e) In a primary election or the general election for state
5858 and county officers in a county with a population of 55,000 or more,
5959 the early voting clerk shall order voting by personal appearance at
6060 the main early voting polling place to be conducted on the last
6161 Saturday of the early voting period for at least 12 hours, except
6262 that voting may not be conducted earlier than 6 a.m. or later than
6363 10 p.m., and on the last Sunday of the early voting period for at
6464 least six hours, except that voting may not be conducted earlier
6565 than 9 a.m. or later than 10 p.m. The early voting clerk shall order
6666 voting to be conducted at those times in those elections in a county
6767 with a population under 55,000 on receipt of a written request for
6868 those hours submitted by at least 15 registered voters of the
6969 county. The request must be submitted in time to enable compliance
7070 with Section 85.007. This subsection supersedes any provision of
7171 this subchapter to the extent of any conflict.
7272 (f) An authority authorized to order extended early voting
7373 under Subsection (a) or (b) that orders the voting during an
7474 extended early voting period shall order personal appearance voting
7575 at the main early voting polling place to be conducted for at least
7676 12 hours on any weekday or Saturday and for at least five hours on
7777 any Sunday of the extended early voting period.
7878 SECTION 4. Sections 85.007(a) and (b), Election Code, are
7979 amended to read as follows:
8080 (a) The election order and the election notice must state:
8181 (1) the date that early voting will begin if under
8282 Section 85.001(d) the early voting period is to begin later than the
8383 prescribed date;
8484 (2) the regular dates and hours that voting will be
8585 conducted under Section 85.005(b); and
8686 (3) the dates and hours that extended voting [on
8787 Saturday or Sunday] is ordered to be conducted under Section
8888 85.006(a).
8989 (b) The early voting clerk shall post notice for each
9090 election stating the dates and hours that extended voting [on a
9191 Saturday or Sunday] is ordered to be conducted under Section
9292 85.006(b).
9393 SECTION 5. Section 85.064(d), Election Code, is amended to
9494 read as follows:
9595 (d) The authority authorized under Section 85.006 to order
9696 extended early voting [on a Saturday or Sunday] may also order, in
9797 the manner prescribed by that section, extended early voting to be
9898 conducted [on a Saturday or Sunday] at any one or more of the
9999 temporary branch polling places. In addition, the early voting
100100 clerk of a county covered by Section 85.006(e) shall order such
101101 voting in accordance with that subsection at each temporary branch
102102 polling place established under Section 85.062(d).
103103 SECTION 6. Section 85.065(b), Election Code, is amended to
104104 read as follows:
105105 (b) Except as provided by Subsection (c), voting at a
106106 temporary branch polling place may be conducted on any days and
107107 during any hours of the period for early voting by personal
108108 appearance, as determined by the authority establishing the branch.
109109 The authority authorized under Section 85.006 to order extended
110110 early voting [on a Saturday or Sunday] may also order, in the manner
111111 prescribed by that section, extended early voting to be conducted
112112 [on a Saturday or Sunday] at any one or more of the temporary branch
113113 polling places.
114114 SECTION 7. Section 85.068(a), Election Code, is amended to
115115 read as follows:
116116 (a) The early voting clerk shall post notice for each
117117 election stating any dates and the hours that extended voting [on
118118 Saturday or Sunday] will be conducted under Section 85.064(d) or
119119 85.065(b), if the early voting clerk is a county clerk or city
120120 secretary under Section 83.002 or 83.005.
121121 SECTION 8. Section 87.0241, Election Code, is amended by
122122 amending Subsection (b) and adding Subsection (b-1) to read as
123123 follows:
124124 (b) The board may not count early voting ballots until:
125125 (1) the polls open on election day; or
126126 (2) in an election conducted by an authority of a
127127 county with a population of 100,000 or more, or conducted jointly
128128 with such a county or conducted with such a county through a
129129 contract for election services, the time the polls close on the
130130 fourth day before election day [end of the period for early voting
131131 by personal appearance].
132132 (b-1) The board may not count early voting ballots voted by
133133 personal appearance after the fourth day before election day until
134134 the end of the extended early voting period.
135135 SECTION 9. This Act takes effect September 1, 2023.
