| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 521.1425, Transportation Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (e) to read as follows: |
|---|
| 12 | 12 | | (e) For purposes of issuing or renewing a driver's license, |
|---|
| 13 | 13 | | the department must accept as satisfactory proof that an applicant |
|---|
| 14 | 14 | | is authorized to be in the United States under Section 521.142(a) |
|---|
| 15 | 15 | | the following documents: |
|---|
| 16 | 16 | | (1) immigration documentation with an alien number or |
|---|
| 17 | 17 | | I-94 number, including a form I-797 indicating the applicant has: |
|---|
| 18 | 18 | | (A) a pending I-485; |
|---|
| 19 | 19 | | (B) a pending application for adjustment, |
|---|
| 20 | 20 | | extension, or change of status; |
|---|
| 21 | 21 | | (C) a pending petition for nonimmigrant worker |
|---|
| 22 | 22 | | status; or |
|---|
| 23 | 23 | | (D) another pending category; |
|---|
| 24 | 24 | | (2) an employment authorization document; |
|---|
| 25 | 25 | | (3) both a valid immigrant visa presented within one |
|---|
| 26 | 26 | | year of endorsement and an unexpired foreign passport; and |
|---|
| 27 | 27 | | (4) the applicant's unexpired foreign passport |
|---|
| 28 | 28 | | presented with both a current border crossing card and an I-94 |
|---|
| 29 | 29 | | number. |
|---|
| 30 | 30 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 31 | 31 | | a driver's license issued or renewed under Chapter 521, |
|---|
| 32 | 32 | | Transportation Code, on or after January 1, 2024. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2023. |
