66 AN ACT
77 relating to required proof of lawful presence in the United States
88 for issuance of a driver's license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.1425, Transportation Code, is
1111 amended by adding Subsection (e) to read as follows:
1212 (e) For purposes of issuing or renewing a driver's license,
1313 the department must accept as satisfactory proof that an applicant
1414 is authorized to be in the United States under Section 521.142(a)
1515 the following documents:
1616 (1) immigration documentation with an alien number or
1717 I-94 number, including a form I-797 indicating the applicant has:
1818 (A) a pending I-485;
1919 (B) a pending application for adjustment,
2020 extension, or change of status;
2121 (C) a pending petition for nonimmigrant worker
2222 status; or
2323 (D) another pending category;
2424 (2) an employment authorization document;
2525 (3) both a valid immigrant visa presented within one
2626 year of endorsement and an unexpired foreign passport; and
2727 (4) the applicant's unexpired foreign passport
2828 presented with both a current border crossing card and an I-94
2929 number.
3030 SECTION 2. The changes in law made by this Act apply only to
3131 a driver's license issued or renewed under Chapter 521,
3232 Transportation Code, on or after January 1, 2024.
3333 SECTION 3. This Act takes effect September 1, 2023.
