| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is |

| 10 | 10 | | amended by adding Section 39.166 to read as follows: |

| 11 | 11 | | Sec. 39.166. RESTRICTION ON POWER PURCHASED FOR ERCOT POWER |

| 12 | 12 | | REGION. (a) Notwithstanding any other law, the commission shall |
|---|
| 13 | 13 | | prohibit an independent organization certified under Section |
|---|
| 14 | 14 | | 39.151 for the ERCOT power region from purchasing more electricity |
|---|
| 15 | 15 | | on a daily basis from a facility capable of generating electricity |
|---|
| 16 | 16 | | for the ERCOT power region than the facility's base generation |
|---|
| 17 | 17 | | capacity. |
|---|
| 18 | 18 | | (b) This section does not apply during a peak demand event |
|---|
| 19 | 19 | | declared by the commission. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect September 1, 2023. |
