55 AN ACT
66 relating to the temporary closure of certain businesses following a
77 violent act on the premises.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 104, Alcoholic Beverage Code, is amended
1010 by adding Section 104.08 to read as follows:
1111 Sec. 104.08. MANDATORY CLOSURE AFTER VIOLENT INCIDENT. (a)
1212 This section applies only to a permit or license holder that:
1313 (1) operates as a bar, nightclub, or similar
1414 commercial venue; and
1515 (2) derives more than 50 percent of the holder's gross
1616 revenue from the sale of alcoholic beverages for on-premises
1717 consumption.
1818 (b) If a shooting, stabbing, or other violent act that
1919 results in the hospitalization or death of an individual occurs on
2020 the premises of a permit or license holder, the permit or license
2121 holder shall immediately close the premises. The permit or license
2222 holder shall keep the premises closed until the 48th hour following
2323 the violent act to allow law enforcement to investigate the
2424 incident unless the law enforcement agency conducting the
2525 investigation authorizes the permit or license holder to reopen the
2626 premises before the 48th hour via written notice, with a carbon copy
2727 sent to Texas Alcoholic Business Commission.
2828 SECTION 2. This Act takes effect September 1, 2023.
