A BILL TO BE ENTITLED
AN ACT
relating to the information relied on by certain agencies for
purposes of rules involving estimates of the intensity, duration,
and frequency of rainfall in this state.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 81, Natural Resources
Code, is amended by adding Section 81.0524 to read as follows:
Sec. 81.0524. RULES REFERENCING RAINFALL INTENSITY,
DURATION, AND FREQUENCY. The commission shall periodically update
rules as necessary to incorporate the latest rainfall intensity,
duration, and frequency data issued by the National Oceanic and
Atmospheric Administration.
SECTION 2. Subchapter D, Chapter 5, Water Code, is amended
by adding Section 5.1036 to read as follows:
Sec. 5.1036. RULES REFERENCING RAINFALL INTENSITY,
DURATION, AND FREQUENCY. The commission shall periodically update
rules as necessary to incorporate the latest rainfall intensity,
duration, and frequency data issued by the National Oceanic and
Atmospheric Administration.
SECTION 3. Not later than January 1, 2024, the Railroad
Commission of Texas and the Texas Commission on Environmental
Quality, as applicable, shall update rules as necessary to comply
with Section 81.0524, Natural Resources Code, and Section 5.1036,
Water Code, as added by this Act.
SECTION 4. This Act takes effect September 1, 2023.
