66 AN ACT
77 relating to prompt payment deadlines for health benefit plan
88 claims affected by a catastrophic event.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 843.337, Insurance Code, is amended by
1111 amending Subsections (b) and (c) and adding Subsection (c-1) to
1212 read as follows:
1313 (b) If a physician or provider fails to submit a claim in
1414 compliance with this section, the physician or provider forfeits
1515 the right to payment [unless the failure to submit the claim in
1616 compliance with this section is a result of a catastrophic event
1717 that substantially interferes with the normal business operations
1818 of the physician or provider].
1919 (c) The period for submitting a claim under this section may
2020 be extended by:
2121 (1) contract;
2222 (2) notice published by the commissioner allowing an
2323 extension of prompt payment deadlines to a later date chosen by the
2424 commissioner due to a catastrophic event; or
2525 (3) the department's approval of a physician's or
2626 provider's request for an extension due to a catastrophic event
2727 that substantially interferes with the normal business operations
2828 of the physician or provider.
2929 (c-1) The commissioner may adopt rules to implement
3030 Subsection (c), including rules establishing requirements for a
3131 request made under Subsection (c)(3).
3232 SECTION 2. Section 843.342(h), Insurance Code, is amended
3333 to read as follows:
3434 (h) A health maintenance organization is not liable for a
3535 penalty under this section:
3636 (1) if the failure to pay the claim in accordance with
3737 this subchapter is a result of a catastrophic event and:
3838 (A) the commissioner published a notice allowing
3939 an extension of the applicable prompt payment deadlines due to the
4040 catastrophic event; or
4141 (B) the department approved the health
4242 maintenance organization's request for an extension due to the
4343 substantial interference of the catastrophic event [that
4444 substantially interferes] with the normal business operations of
4545 the health maintenance organization; or
4646 (2) if the claim was paid in accordance with this
4747 subchapter, but for less than the contracted rate, and:
4848 (A) the physician or provider notifies the health
4949 maintenance organization of the underpayment after the 270th day
5050 after the date the underpayment was received; and
5151 (B) the health maintenance organization pays the
5252 balance of the claim on or before the 30th day after the date the
5353 health maintenance organization receives the notice.
5454 SECTION 3. Section 1301.102, Insurance Code, is amended by
5555 amending Subsections (d) and (e) and adding Subsection (e-1) to
5656 read as follows:
5757 (d) If a physician or health care provider fails to submit a
5858 claim in compliance with this section, the physician or provider
5959 forfeits the right to payment [unless the failure to submit the
6060 claim in compliance with this section is a result of a catastrophic
6161 event that substantially interferes with the normal business
6262 operations of the physician or provider].
6363 (e) The period for submitting a claim under this section may
6464 be extended by:
6565 (1) contract;
6666 (2) notice published by the commissioner allowing an
6767 extension of prompt payment deadlines to a later date chosen by the
6868 commissioner due to a catastrophic event; or
6969 (3) the department's approval of a physician's or
7070 health care provider's request for an extension due to a
7171 catastrophic event that substantially interferes with the normal
7272 business operations of the physician or provider.
7373 (e-1) The commissioner may adopt rules to implement
7474 Subsection (e), including rules establishing requirements for a
7575 request made under Subsection (e)(3).
7676 SECTION 4. Section 1301.137(h), Insurance Code, is amended
7777 to read as follows:
7878 (h) An insurer is not liable for a penalty under this
7979 section:
8080 (1) if the failure to pay the claim in accordance with
8181 Subchapter C is a result of a catastrophic event and:
8282 (A) the commissioner published a notice allowing
8383 an extension of the applicable prompt payment deadlines due to the
8484 catastrophic event; or
8585 (B) the department approved the insurer's
8686 request for an extension due to the substantial interference of the
8787 catastrophic event [that substantially interferes] with the normal
8888 business operations of the insurer; or
8989 (2) if the claim was paid in accordance with
9090 Subchapter C, but for less than the contracted rate, and:
9191 (A) the preferred provider notifies the insurer
9292 of the underpayment after the 270th day after the date the
9393 underpayment was received; and
9494 (B) the insurer pays the balance of the claim on
9595 or before the 30th day after the date the insurer receives the
9696 notice.
9797 SECTION 5. The changes in law made by this Act apply only to
9898 a claim submitted on or after the effective date of this Act. A
9999 claim submitted before the effective date of this Act is governed by
100100 the law as it existed immediately before the effective date of this
101101 Act, and that law is continued in effect for that purpose.
102102 SECTION 6. This Act takes effect September 1, 2023.
