| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 418.062, Government Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | Sec. 418.062. ELIGIBILITY FOR LOAN. A political |
|---|
| 11 | 11 | | subdivision may apply to the division for a loan under this |
|---|
| 12 | 12 | | subchapter if: |
|---|
| 13 | 13 | | (1) the political subdivision: |
|---|
| 14 | 14 | | (A) is located wholly or partly in an area |
|---|
| 15 | 15 | | declared to be a disaster area by the governor or the president of |
|---|
| 16 | 16 | | the United States; and |
|---|
| 17 | 17 | | (B) before applying to the division for a loan |
|---|
| 18 | 18 | | under this subchapter: |
|---|
| 19 | 19 | | (i) has submitted to the division, within |
|---|
| 20 | 20 | | 30 [15] days of the date of its adoption by the governing body of the |
|---|
| 21 | 21 | | political subdivision, the political subdivision's operating |
|---|
| 22 | 22 | | budget for the most recent fiscal year; and |
|---|
| 23 | 23 | | (ii) has submitted an application for a |
|---|
| 24 | 24 | | loan from the Federal Emergency Management Agency's community |
|---|
| 25 | 25 | | disaster loan program; |
|---|
| 26 | 26 | | (2) an assessment of damages due to the disaster for |
|---|
| 27 | 27 | | which the declaration was made has been conducted in the political |
|---|
| 28 | 28 | | subdivision; and |
|---|
| 29 | 29 | | (3) the division, in consultation with the Federal |
|---|
| 30 | 30 | | Emergency Management Agency, determines that the estimated cost to |
|---|
| 31 | 31 | | rebuild the political subdivision's infrastructure damaged in the |
|---|
| 32 | 32 | | disaster is greater than 50 percent of the political subdivision's |
|---|
| 33 | 33 | | total revenue for the current year as shown in the most recent |
|---|
| 34 | 34 | | operating budget of the political subdivision submitted to the |
|---|
| 35 | 35 | | division under this section. |
|---|
| 36 | 36 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an application for a loan that is filed on or after the effective |
|---|
| 38 | 38 | | date of this Act. A loan application filed before that date is |
|---|
| 39 | 39 | | governed by the law in effect on the date the application was filed, |
|---|
| 40 | 40 | | and the former law is continued in effect for that purpose. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2023. |
