| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 418.113(d), Government Code, is amended |
|---|
| 8 | 8 | | to read as follows: |
|---|
| 9 | 9 | | (d) The chair of the emergency management council [public |
|---|
| 10 | 10 | | safety director of the Department of Public Safety of the State of |
|---|
| 11 | 11 | | Texas] shall appoint a chair of each disaster district committee |
|---|
| 12 | 12 | | based on the declared disaster and phase of disaster response in |
|---|
| 13 | 13 | | accordance with the National Incident Management System guidelines |
|---|
| 14 | 14 | | [commanding officer from the Texas Highway Patrol to serve as chair |
|---|
| 15 | 15 | | of each disaster district committee]. The chair of each disaster |
|---|
| 16 | 16 | | district committee shall: |
|---|
| 17 | 17 | | (1) inform the chair of the emergency management |
|---|
| 18 | 18 | | council [state Director of Homeland Security] on all matters |
|---|
| 19 | 19 | | relating to disasters and emergencies as requested by the chair of |
|---|
| 20 | 20 | | the emergency management council [state Director of Homeland |
|---|
| 21 | 21 | | Security]; and |
|---|
| 22 | 22 | | (2) inform the public safety director of the |
|---|
| 23 | 23 | | Department of Public Safety of the State of Texas on all matters as |
|---|
| 24 | 24 | | requested by the public safety director. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
