| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 157.0511, Occupations Code, is amended |
|---|
| 12 | 12 | | by adding Subsection (d) to read as follows: |
|---|
| 13 | 13 | | (d) A physician may not supervise or delegate the |
|---|
| 14 | 14 | | prescribing or ordering of a drug or device under this subchapter to |
|---|
| 15 | 15 | | a physician assistant or advanced practice registered nurse if the |
|---|
| 16 | 16 | | physician has, in the preceding two years, been subject to |
|---|
| 17 | 17 | | disciplinary action for a standard of care violation by the board or |
|---|
| 18 | 18 | | a medical licensing board of any other state. |

| 19 | 19 | | SECTION 2. This Act takes effect September 1, 2023. |
