55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requirements for the renewal of a physician's
88 registration permit.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 156.001, Occupations Code, is amended by
1111 adding Subsection (d-1) to read as follows:
1212 (d-1) If the license holder supervises or delegates medical
1313 acts to any non-physician health care provider, the license holder
1414 shall attest on the registration renewal application that the
1515 license holder has provided proper supervision and has properly
1616 delegated medical acts:
1717 (1) generally, for any non-physician health care
1818 provider; and
1919 (2) specifically, for any advanced practice
2020 registered nurse or physician assistant with whom the license
2121 holder has entered into a prescriptive authority agreement under
2222 Section 157.0512.
2323 SECTION 2. Not later than December 1, 2023, the Texas
2424 Medical Board by rule shall prescribe the method by which a
2525 physician who renews the physician's registration permit may make
2626 and electronically sign the attestation required by Section
2727 156.001(d-1), Occupations Code, as added by this Act.
2828 SECTION 3. Section 156.001(d-1), Occupations Code, as added
2929 by this Act, applies only to an application for renewal of a
3030 registration permit submitted on or after January 1, 2024.
3131 SECTION 4. This Act takes effect September 1, 2023.
