6	6	AN ACT
7	7	relating to requiring fine arts as part of the foundation
8	8	curriculum for public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Sections 28.002(a) and (n), Education Code, are
11	11	amended to read as follows:
12	12	(a) Each school district that offers kindergarten through
13	13	grade 12 shall offer, as a required curriculum:
14	14	(1) a foundation curriculum that includes:
15	15	(A) English language arts;
16	16	(B) mathematics;
17	17	(C) science; [and]
18	18	(D) social studies, consisting of Texas, United
19	19	States, and world history, government, economics, with emphasis on
20	20	the free enterprise system and its benefits, and geography; and
21	21	(E) fine arts; and
22	22	(2) an enrichment curriculum that includes:
23	23	(A) to the extent possible, languages other than
24	24	English;
25	25	(B) health, with emphasis on:
26	26	(i) physical health, including the
27	27	importance of proper nutrition and exercise;
28	28	(ii) mental health, including instruction
29	29	about mental health conditions, substance abuse, skills to manage
30	30	emotions, establishing and maintaining positive relationships, and
31	31	responsible decision-making; and
32	32	(iii) suicide prevention, including
33	33	recognizing suicide-related risk factors and warning signs;
34	34	(C) physical education;
35	35	(D) [fine arts;
36	36	[(E)] career and technology education;
37	37	(E) [(F)] technology applications;
38	38	(F) [(G)] religious literature, including the
39	39	Hebrew Scriptures (Old Testament) and New Testament, and its impact
40	40	on history and literature; and
41	41	(G) [(H)] personal financial literacy.
42	42	(n) The State Board of Education may by rule develop and
43	43	implement a plan designed to incorporate foundation curriculum
44	44	requirements into the career and technology education curriculum
45	45	under Subsection (a)(2)(D) [(a)(2)(E)].
46	46	SECTION 2. Section 28.003(b), Education Code, is amended to
47	47	read as follows:
48	48	(b) In this section, "educational program" means a course or
49	49	series of courses in the required curriculum under Section 28.002,
50	50	other than a fine arts course under Section 28.002(a)(1)(E)
51	51	[28.002(a)(2)(D)] or a career and technology course under Section
52	52	28.002(a)(2)(D) [28.002(a)(2)(E)].
53	53	SECTION 3. Section 28.025(b-1), Education Code, is amended
54	54	to read as follows:
55	55	(b-1) The State Board of Education by rule shall require
56	56	that the curriculum requirements for the foundation high school
57	57	program under Subsection (a) include a requirement that students
58	58	successfully complete:
59	59	(1) four credits in English language arts under
60	60	Section 28.002(a)(1)(A), including one credit in English I, one
61	61	credit in English II, one credit in English III, and one credit in
62	62	an advanced English course authorized under Subsection (b-2);
63	63	(2) three credits in mathematics under Section
64	64	28.002(a)(1)(B), including one credit in Algebra I, one credit in
65	65	geometry, and one credit in any advanced mathematics course
66	66	authorized under Subsection (b-2);
67	67	(3) three credits in science under Section
68	68	28.002(a)(1)(C), including one credit in biology, one credit in any
69	69	advanced science course authorized under Subsection (b-2), and one
70	70	credit in integrated physics and chemistry or in an additional
71	71	advanced science course authorized under Subsection (b-2);
72	72	(4) three credits in social studies under Section
73	73	28.002(a)(1)(D), including one credit in United States history, at
74	74	least one-half credit in government and at least one-half credit in
75	75	economics or personal financial literacy & economics, and one
76	76	credit in world geography or world history;
77	77	(5) except as provided under Subsections (b-12),
78	78	(b-13), and (b-14), two credits in the same language in a language
79	79	other than English under Section 28.002(a)(2)(A);
80	80	(6) five elective credits;
81	81	(7) one credit in fine arts under Section
82	82	28.002(a)(1)(E) [28.002(a)(2)(D)]; and
83	83	(8) except as provided by Subsection (b-11), one
84	84	credit in physical education under Section 28.002(a)(2)(C).
85	85	SECTION 4. This Act applies beginning with the 2023-2024
86	86	school year.
87	87	SECTION 5. This Act takes effect immediately if it receives
88	88	a vote of two-thirds of all the members elected to each house, as
89	89	provided by Section 39, Article III, Texas Constitution. If this
90	90	Act does not receive the vote necessary for immediate effect, this
91	91	Act takes effect September 1, 2023.
