55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring fine arts as part of the foundation
88 curriculum for public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 28.002(a) and (n), Education Code, are
1111 amended to read as follows:
1212 (a) Each school district that offers kindergarten through
1313 grade 12 shall offer, as a required curriculum:
1414 (1) a foundation curriculum that includes:
1515 (A) English language arts;
1616 (B) mathematics;
1717 (C) science; [and]
1818 (D) social studies, consisting of Texas, United
1919 States, and world history, government, economics, with emphasis on
2020 the free enterprise system and its benefits, and geography; and
2121 (E) fine arts; and
2222 (2) an enrichment curriculum that includes:
2323 (A) to the extent possible, languages other than
2424 English;
2525 (B) health, with emphasis on:
2626 (i) physical health, including the
2727 importance of proper nutrition and exercise;
2828 (ii) mental health, including instruction
2929 about mental health conditions, substance abuse, skills to manage
3030 emotions, establishing and maintaining positive relationships, and
3131 responsible decision-making; and
3232 (iii) suicide prevention, including
3333 recognizing suicide-related risk factors and warning signs;
3434 (C) physical education;
3535 (D) [fine arts;
3636 [(E)] career and technology education;
3737 (E) [(F)] technology applications;
3838 (F) [(G)] religious literature, including the
3939 Hebrew Scriptures (Old Testament) and New Testament, and its impact
4040 on history and literature; and
4141 (G) [(H)] personal financial literacy.
4242 (n) The State Board of Education may by rule develop and
4343 implement a plan designed to incorporate foundation curriculum
4444 requirements into the career and technology education curriculum
4545 under Subsection (a)(2)(D) [(a)(2)(E)].
4646 SECTION 2. Section 28.003(b), Education Code, is amended to
4747 read as follows:
4848 (b) In this section, "educational program" means a course or
4949 series of courses in the required curriculum under Section 28.002,
5050 other than a fine arts course under Section 28.002(a)(1)(E)
5151 [28.002(a)(2)(D)] or a career and technology course under Section
5252 28.002(a)(2)(D) [28.002(a)(2)(E)].
5353 SECTION 3. Section 28.025(b-1), Education Code, is amended
5454 to read as follows:
5555 (b-1) The State Board of Education by rule shall require
5656 that the curriculum requirements for the foundation high school
5757 program under Subsection (a) include a requirement that students
5858 successfully complete:
5959 (1) four credits in English language arts under
6060 Section 28.002(a)(1)(A), including one credit in English I, one
6161 credit in English II, one credit in English III, and one credit in
6262 an advanced English course authorized under Subsection (b-2);
6363 (2) three credits in mathematics under Section
6464 28.002(a)(1)(B), including one credit in Algebra I, one credit in
6565 geometry, and one credit in any advanced mathematics course
6666 authorized under Subsection (b-2);
6767 (3) three credits in science under Section
6868 28.002(a)(1)(C), including one credit in biology, one credit in any
6969 advanced science course authorized under Subsection (b-2), and one
7070 credit in integrated physics and chemistry or in an additional
7171 advanced science course authorized under Subsection (b-2);
7272 (4) three credits in social studies under Section
7373 28.002(a)(1)(D), including one credit in United States history, at
7474 least one-half credit in government and at least one-half credit in
7575 economics or personal financial literacy & economics, and one
7676 credit in world geography or world history;
7777 (5) except as provided under Subsections (b-12),
7878 (b-13), and (b-14), two credits in the same language in a language
7979 other than English under Section 28.002(a)(2)(A);
8080 (6) five elective credits;
8181 (7) one credit in fine arts under Section
8282 28.002(a)(1)(E) [28.002(a)(2)(D)]; and
8383 (8) except as provided by Subsection (b-11), one
8484 credit in physical education under Section 28.002(a)(2)(C).
8585 SECTION 4. This Act applies beginning with the 2023-2024
8686 school year.
8787 SECTION 5. This Act takes effect immediately if it receives
8888 a vote of two-thirds of all the members elected to each house, as
8989 provided by Section 39, Article III, Texas Constitution. If this
9090 Act does not receive the vote necessary for immediate effect, this
9191 Act takes effect September 1, 2023.
