| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 401.015(a), Health and Safety Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (a) The radiation advisory board is composed of the |
|---|
| 14 | 14 | | following 19 [18] members appointed by the governor: |
|---|
| 15 | 15 | | (1) one representative from industry who is trained in |
|---|
| 16 | 16 | | nuclear physics, science, or nuclear engineering; |
|---|
| 17 | 17 | | (2) one representative from labor; |
|---|
| 18 | 18 | | (3) one representative from agriculture; |
|---|
| 19 | 19 | | (4) one representative from the insurance industry; |
|---|
| 20 | 20 | | (5) one individual who is engaged in the use and |
|---|
| 21 | 21 | | application of nuclear physics in medicine and is certified by the |
|---|
| 22 | 22 | | American Board of Radiology or licensed by the Texas Medical Board |
|---|
| 23 | 23 | | under Chapter 602, Occupations Code; |
|---|
| 24 | 24 | | (6) one hospital administrator; |
|---|
| 25 | 25 | | (7) one individual licensed by the Texas Medical Board |
|---|
| 26 | 26 | | who specializes in nuclear medicine; |
|---|
| 27 | 27 | | (8) one individual licensed by the Texas Medical Board |
|---|
| 28 | 28 | | who specializes in pathology; |
|---|
| 29 | 29 | | (9) one individual licensed by the Texas Medical Board |
|---|
| 30 | 30 | | who specializes in radiology; |
|---|
| 31 | 31 | | (10) one representative from the nuclear utility |
|---|
| 32 | 32 | | industry; |
|---|
| 33 | 33 | | (11) one representative from the radioactive waste |
|---|
| 34 | 34 | | industry; |
|---|
| 35 | 35 | | (12) one representative from the petroleum industry; |
|---|
| 36 | 36 | | (13) one health physicist certified by the American |
|---|
| 37 | 37 | | Board of Health Physics; |
|---|
| 38 | 38 | | (14) one individual licensed by the State Board of |
|---|
| 39 | 39 | | Dental Examiners; |
|---|
| 40 | 40 | | (15) one representative from the uranium mining |
|---|
| 41 | 41 | | industry; [and] |
|---|
| 42 | 42 | | (16) one individual licensed by the State Board of |
|---|
| 43 | 43 | | Veterinary Medical Examiners; and |
|---|
| 44 | 44 | | (17) three representatives of the public. |
|---|
| 45 | 45 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 46 | 46 | | of this Act, the governor shall appoint an individual licensed by |
|---|
| 47 | 47 | | the State Board of Veterinary Medical Examiners to the radiation |
|---|
| 48 | 48 | | advisory board as required by Section 401.015, Health and Safety |
|---|
| 49 | 49 | | Code, as amended by this Act. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 54 | 54 | | Act takes effect September 1, 2023. |
