88 AN ACT
99 relating to the composition of the radiation advisory board.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 401.015(a), Health and Safety Code, is
1212 amended to read as follows:
1313 (a) The radiation advisory board is composed of the
1414 following 19 [18] members appointed by the governor:
1515 (1) one representative from industry who is trained in
1616 nuclear physics, science, or nuclear engineering;
1717 (2) one representative from labor;
1818 (3) one representative from agriculture;
1919 (4) one representative from the insurance industry;
2020 (5) one individual who is engaged in the use and
2121 application of nuclear physics in medicine and is certified by the
2222 American Board of Radiology or licensed by the Texas Medical Board
2323 under Chapter 602, Occupations Code;
2424 (6) one hospital administrator;
2525 (7) one individual licensed by the Texas Medical Board
2626 who specializes in nuclear medicine;
2727 (8) one individual licensed by the Texas Medical Board
2828 who specializes in pathology;
2929 (9) one individual licensed by the Texas Medical Board
3030 who specializes in radiology;
3131 (10) one representative from the nuclear utility
3232 industry;
3333 (11) one representative from the radioactive waste
3434 industry;
3535 (12) one representative from the petroleum industry;
3636 (13) one health physicist certified by the American
3737 Board of Health Physics;
3838 (14) one individual licensed by the State Board of
3939 Dental Examiners;
4040 (15) one representative from the uranium mining
4141 industry; [and]
4242 (16) one individual licensed by the State Board of
4343 Veterinary Medical Examiners; and
4444 (17) three representatives of the public.
4545 SECTION 2. As soon as practicable after the effective date
4646 of this Act, the governor shall appoint an individual licensed by
4747 the State Board of Veterinary Medical Examiners to the radiation
4848 advisory board as required by Section 401.015, Health and Safety
4949 Code, as amended by this Act.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2023.
