55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a family service plan.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 263.102, Family Code, is amended by
1010 adding Subsections (g), (h), (i), (j), and (k) to read as follows:
1111 (g) In preparing a service plan, the department shall make
1212 reasonable accommodations for a parent with a disability as
1313 required by the Americans with Disabilities Act (42 U.S.C. Section
1414 12101 et seq.).
1515 (h) Services ordered in the service plan must be narrowly
1616 tailored to address the reason for the child's removal.
1717 (i) If the court finds under Section 262.201 that a parent,
1818 managing conservator, possessory conservator, guardian, caretaker,
1919 or custodian entitled to possession did not cause the immediate
2020 danger to the physical health or safety of the child or was not the
2121 perpetrator of the neglect or abuse alleged in the suit, the court
2222 may not require that parent, managing conservator, possessory
2323 conservator, guardian, caretaker, or custodian entitled to
2424 possession to participate in services ordered in the service plan.
2525 (j) A person receiving services under a service plan may
2626 obtain those services from a qualified provider selected by the
2727 person if:
2828 (1) the selected provider is qualified or licensed to
2929 provide the services ordered under the service plan;
3030 (2) the services provided by the selected provider:
3131 (A) meet the scope and duration of the services
3232 ordered under the service plan; and
3333 (B) achieve the stated goals of the service plan;
3434 and
3535 (3) the person selecting the provider pays for the
3636 services.
3737 (k) A person receiving services from a service provider
3838 selected under Subsection (j) who successfully completes the
3939 services must obtain written verification from the service provider
4040 of that completion. The department shall accept the service
4141 provider's verification as proof that the person has successfully
4242 completed the services ordered under the service plan.
4343 SECTION 2. The change in law made by this Act applies only
4444 to a service plan that is created on or after the effective date of
4545 this Act.
4646 SECTION 3. This Act takes effect September 1, 2023.
