66 AN ACT
77 relating to a requirement to report certain semiautomatic rifle
88 sales and other transfers to the county sheriff.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 6, Business & Commerce Code, is amended by
1111 adding Chapter 205 to read as follows:
1212 CHAPTER 205. REPORTS OF CERTAIN FIREARM TRANSFERS
1313 Sec. 205.001. DEFINITION. In this chapter, "licensed
1414 firearms dealer" means a person who is licensed as a firearms dealer
1515 under 18 U.S.C. Section 923.
1616 Sec. 205.002. APPLICABILITY. This chapter applies only to
1717 a semiautomatic rifle that:
1818 (1) is capable of accepting a detachable magazine; and
1919 (2) has a caliber greater than .22.
2020 Sec. 205.003. REPORT. A licensed firearms dealer who sells
2121 or otherwise transfers a semiautomatic rifle described by Section
2222 205.002 to a person who is under 21 years of age promptly shall
2323 report the transfer to the sheriff of the county in which the
2424 transfer occurred.
2525 SECTION 2. The change in law made by this Act applies only
2626 to the sale or other transfer of a firearm that occurs on or after
2727 the effective date of this Act. A sale or other transfer of a
2828 firearm that occurs before the effective date of this Act is
2929 governed by the law in effect immediately before the effective date
3030 of this Act, and that law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2023.
