66 AN ACT
77 relating to creating the criminal offense of prosecutorial
88 misconduct.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 39, Penal Code, is amended by adding
1111 Section 39.08 to read as follows:
1212 Sec. 39.08. PROSECUTORIAL MISCONDUCT. (a) In this
1313 section, "prosecuting attorney" means an attorney who represents
1414 the state in a criminal action.
1515 (b) A person commits an offense if:
1616 (1) the person is a prosecuting attorney or working on
1717 behalf of a prosecuting attorney in a criminal action;
1818 (2) the person intentionally destroys, withholds from
1919 the defendant, or otherwise fails to disclose to the defendant
2020 information that the attorney or person is required to disclose
2121 under Article 39.14(h), Code of Criminal Procedure;
2222 (3) the defendant is actually innocent of the offense
2323 with which the defendant is charged; and
2424 (4) the conduct described by Subdivision (2) was a
2525 substantial contributing factor to the wrongful conviction of the
2626 defendant.
2727 (c) A person commits an offense if the person:
2828 (1) is a prosecuting attorney; and
2929 (2) intentionally obstructs the exoneration of a
3030 defendant for an offense of which the person knows the defendant was
3131 actually innocent and wrongfully convicted.
3232 (d) An offense under this section is a felony of the second
3333 degree.
3434 (e) If conduct constituting an offense under this section
3535 also constitutes an offense under another section of this code, the
3636 actor may be prosecuted under either section or under both
3737 sections.
3838 SECTION 2. This Act takes effect September 1, 2023.
