| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 72, Government Code, is |
|---|
| 10 | 10 | | amended by amending Section 72.039 to read as follows: |
|---|
| 11 | 11 | | Sec. 72.039. DISTRICT COURT WORKLOAD ANALYSIS. (a) In this |
|---|
| 12 | 12 | | section: |
|---|
| 13 | 13 | | (1) "Judicial officer" means a district judge, |
|---|
| 14 | 14 | | associate judge, master, magistrate, or referee; and |
|---|
| 15 | 15 | | (2) "Clearance rate" has the same meaning as that term |
|---|
| 16 | 16 | | is defined in Section 72.083. |
|---|
| 17 | 17 | | (b) The office shall biennially conduct a district court |
|---|
| 18 | 18 | | workload analysis by collecting information on the 30 most populous |
|---|
| 19 | 19 | | counties in the state relating to: |
|---|
| 20 | 20 | | (1) the number of estimated full-time equivalent |
|---|
| 21 | 21 | | judicial officers working in the county in the preceding fiscal |
|---|
| 22 | 22 | | year; |
|---|
| 23 | 23 | | (2) the number of full-time equivalent judicial |
|---|
| 24 | 24 | | officers needed in the county based on the most recent weighted |
|---|
| 25 | 25 | | caseload study; |
|---|
| 26 | 26 | | (3) the number of new case filings in each of the |
|---|
| 27 | 27 | | preceding five fiscal years; |
|---|
| 28 | 28 | | (4) the clearance rate of cases in each of the |
|---|
| 29 | 29 | | preceding five fiscal years; |
|---|
| 30 | 30 | | (5) the calendar year in which the last district court |
|---|
| 31 | 31 | | was created by statute; and |
|---|
| 32 | 32 | | (6) any other information identified by the director. |
|---|
| 33 | 33 | | (c) No later than October 1st of every even-numbered year, |
|---|
| 34 | 34 | | the office shall report to the governor, lieutenant governor, and |
|---|
| 35 | 35 | | the members of the legislature the information collected under |
|---|
| 36 | 36 | | Subsection (b). |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2023. |
