77 relating to regular reporting of district court workload.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 72, Government Code, is
1010 amended by amending Section 72.039 to read as follows:
1111 Sec. 72.039. DISTRICT COURT WORKLOAD ANALYSIS. (a) In this
1212 section:
1313 (1) "Judicial officer" means a district judge,
1414 associate judge, master, magistrate, or referee; and
1515 (2) "Clearance rate" has the same meaning as that term
1616 is defined in Section 72.083.
1717 (b) The office shall biennially conduct a district court
1818 workload analysis by collecting information on the 30 most populous
1919 counties in the state relating to:
2020 (1) the number of estimated full-time equivalent
2121 judicial officers working in the county in the preceding fiscal
2222 year;
2323 (2) the number of full-time equivalent judicial
2424 officers needed in the county based on the most recent weighted
2525 caseload study;
2626 (3) the number of new case filings in each of the
2727 preceding five fiscal years;
2828 (4) the clearance rate of cases in each of the
2929 preceding five fiscal years;
3030 (5) the calendar year in which the last district court
3131 was created by statute; and
3232 (6) any other information identified by the director.
3333 (c) No later than October 1st of every even-numbered year,
3434 the office shall report to the governor, lieutenant governor, and
3535 the members of the legislature the information collected under
3636 Subsection (b).
3737 SECTION 3. This Act takes effect September 1, 2023.
