55 AN ACT
66 relating to an alternate board certification to signify
77 accreditation within a given specialty in this state and medical
88 care provided at certain health care facilities by physicians with
99 an alternate board certification.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 222, Health and Safety Code, is amended
1212 by adding Subchapter D to read as follows:
1313 SUBCHAPTER D. MEDICAL CARE PROVIDED BY PHYSICIANS WITH ALTERNATE
1414 BOARD CERTIFICATIONS AT CERTAIN HEALTH CARE FACILITIES
1515 Sec. 222.101. DEFINITIONS. In this chapter:
1616 (1) "Commission" means the Health and Human Services
1717 Commission.
1818 (2) "Executive commissioner" means the executive
1919 commissioner of the commission.
2020 (3) "Health care facility" means a health care
2121 facility licensed by the commission.
2222 Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH
2323 ALTERNATE BOARD CERTIFICATION TO PRACTICE MEDICINE; FACILITY
2424 LICENSE REVOCATION. (a) A health care facility may not refuse to
2525 accept for board certification purposes a physician's alternate
2626 board certification to practice medicine issued under Section
2727 155.012, Occupations Code, in employing or granting practice or
2828 admitting privileges to the physician for providing medical care to
2929 patients at the facility or otherwise discriminate against the
3030 physician in making an employment or privilege decision based on
3131 the physician's alternate board certification.
3232 (b) The commission shall revoke the license of a health care
3333 facility that violates this section.
3434 (c) The executive commissioner shall adopt rules to
3535 implement this section.
3636 SECTION 2. Subchapter A, Chapter 155, Occupations Code, is
3737 amended by adding Section 155.012 to read as follows:
3838 Sec. 155.012. ALTERNATE BOARD CERTIFICATION FOR CERTAIN
3939 APPLICANTS. (a) The board shall allow alternate board
4040 certifications to practice medicine in this state that:
4141 (1) requires an applicant to satisfy each applicable
4242 eligibility requirement for a board certification under this
4343 chapter except as provided by Subdivision (2); and
4444 (2) does not require an applicant to complete courses
4545 or training on or to satisfy any other requirement, including
4646 obtaining certification, for:
4747 (a) providing a medical treatment or procedure
4848 that is unlawful in the State of Texas.
4949 (b) The board shall adopt rules to implement this section.
5050 SECTION 3. As soon as practicable after the effective date
5151 of this Act:
5252 (1) the executive commissioner of the Health and Human
5353 Services Commission shall adopt the rules necessary to implement
5454 Subchapter D, Chapter 222, Health and Safety Code, as added by this
5555 Act; and
5656 (2) the Texas Medical Board shall adopt rules to
5757 implement the alternate board certification to signify
5858 accreditation within a given specialty in this state as required by
5959 Section 155.012, Occupations Code, as added by this Act.
6060 SECTION 4. This Act takes effect September 1, 2023.
