| 7 | 7 | | accreditation within a given specialty in this state and medical |

| 8 | 8 | | care provided at certain health care facilities by physicians with |
|---|
| 9 | 9 | | an alternate board certification. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 222, Health and Safety Code, is amended |
|---|
| 12 | 12 | | by adding Subchapter D to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER D. MEDICAL CARE PROVIDED BY PHYSICIANS WITH ALTERNATE |
|---|
| 14 | 14 | | BOARD CERTIFICATIONS AT CERTAIN HEALTH CARE FACILITIES |
|---|
| 15 | 15 | | Sec. 222.101. DEFINITIONS. In this chapter: |
|---|
| 16 | 16 | | (1) "Commission" means the Health and Human Services |
|---|
| 17 | 17 | | Commission. |
|---|
| 18 | 18 | | (2) "Executive commissioner" means the executive |
|---|
| 19 | 19 | | commissioner of the commission. |
|---|
| 20 | 20 | | (3) "Health care facility" means a health care |
|---|
| 21 | 21 | | facility licensed by the commission. |
|---|
| 22 | 22 | | Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH |
|---|
| 23 | 23 | | ALTERNATE BOARD CERTIFICATION TO PRACTICE MEDICINE; FACILITY |
|---|
| 24 | 24 | | LICENSE REVOCATION. (a) A health care facility may not refuse to |
|---|
| 25 | 25 | | accept for board certification purposes a physician's alternate |
|---|
| 26 | 26 | | board certification to practice medicine issued under Section |
|---|
| 27 | 27 | | 155.012, Occupations Code, in employing or granting practice or |
|---|
| 28 | 28 | | admitting privileges to the physician for providing medical care to |
|---|
| 29 | 29 | | patients at the facility or otherwise discriminate against the |
|---|
| 30 | 30 | | physician in making an employment or privilege decision based on |
|---|
| 31 | 31 | | the physician's alternate board certification. |
|---|
| 32 | 32 | | (b) The commission shall revoke the license of a health care |
|---|
| 33 | 33 | | facility that violates this section. |
|---|
| 34 | 34 | | (c) The executive commissioner shall adopt rules to |
|---|
| 35 | 35 | | implement this section. |
|---|
| 36 | 36 | | SECTION 2. Subchapter A, Chapter 155, Occupations Code, is |
|---|
| 37 | 37 | | amended by adding Section 155.012 to read as follows: |
|---|
| 38 | 38 | | Sec. 155.012. ALTERNATE BOARD CERTIFICATION FOR CERTAIN |
|---|
| 39 | 39 | | APPLICANTS. (a) The board shall allow alternate board |
|---|
| 40 | 40 | | certifications to practice medicine in this state that: |
|---|
| 41 | 41 | | (1) requires an applicant to satisfy each applicable |
|---|
| 42 | 42 | | eligibility requirement for a board certification under this |
|---|
| 43 | 43 | | chapter except as provided by Subdivision (2); and |
|---|
| 44 | 44 | | (2) does not require an applicant to complete courses |
|---|
| 45 | 45 | | or training on or to satisfy any other requirement, including |
|---|
| 46 | 46 | | obtaining certification, for: |
|---|
| 47 | 47 | | (a) providing a medical treatment or procedure |
|---|
| 48 | 48 | | that is unlawful in the State of Texas. |
|---|
| 49 | 49 | | (b) The board shall adopt rules to implement this section. |
|---|
| 50 | 50 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 51 | 51 | | of this Act: |
|---|
| 52 | 52 | | (1) the executive commissioner of the Health and Human |
|---|
| 53 | 53 | | Services Commission shall adopt the rules necessary to implement |
|---|
| 54 | 54 | | Subchapter D, Chapter 222, Health and Safety Code, as added by this |
|---|
| 55 | 55 | | Act; and |
|---|
| 56 | 56 | | (2) the Texas Medical Board shall adopt rules to |
|---|
| 57 | 57 | | implement the alternate board certification to signify |
|---|
| 58 | 58 | | accreditation within a given specialty in this state as required by |
|---|
| 59 | 59 | | Section 155.012, Occupations Code, as added by this Act. |
|---|
| 60 | 60 | | SECTION 4. This Act takes effect September 1, 2023. |
