7	7	relating to the creation of a non-REAL ID personal identification
8	8	certificate; authorizing a fee.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 521, Transportation Code, is amended by
11	11	adding Subchapter E-1 to read as follows:
12	12	SUBCHAPTER E-1. NON-REAL ID PERSONAL IDENTIFICATION CERTIFICATE
13	13	Sec. 521.110. ELIGIBILITY. The department may issue a
14	14	non-REAL ID personal identification certificate to an applicant
15	15	who:
16	16	(1) as of the date the certificate is issued, resides
17	17	in this state; and
18	18	(2) meets the requirements for the issuance of a
19	19	personal identification certificate under Subchapter E other than
20	20	an application requirement described by Section 521.101(d-1),
21	21	521.1015(c)(1), or 521.1016(c)(1).
22	22	Sec. 521.111. NOT TO BE USED AS IDENTIFICATION FOR FEDERAL
23	23	OR VOTING PURPOSES. A non-REAL ID personal identification
24	24	certificate issued under this subchapter is not valid as proof of
25	25	the certificate holder's identity for any federal purposes or for
26	26	purposes of voting in any election, including a national, state, or
27	27	local election.
28	28	Sec. 521.112. NON-REAL ID PERSONAL IDENTIFICATION
29	29	CERTIFICATE. (a) The department shall:
30	30	(1) designate and clearly mark as a non-REAL ID
31	31	personal identification certificate each certificate issued under
32	32	this subchapter; and
33	33	(2) include on a certificate issued under this
34	34	subchapter an indication that the certificate is not valid proof of
35	35	identity for any federal or voting purposes.
36	36	(b) Except as otherwise provided by this subchapter, the
37	37	provisions of this chapter and other law applicable to the issuance
38	38	or renewal of, an applicant or application for, or a holder of a
39	39	personal identification certificate are applicable to the issuance
40	40	or renewal of, an applicant or application for, or a holder of a
41	41	non-REAL ID personal identification certificate.
42	42	Sec. 521.113. RULES. (a) The department shall adopt rules
43	43	to implement this subchapter, including rules:
44	44	(1) regarding the design and content of the non-REAL
45	45	ID personal identification certificate; and
46	46	(2) establishing criteria for proof of identification
47	47	and residency of an applicant.
48	48	(b) Rules establishing criteria for proof of identification
49	49	must allow an applicant to establish identity through presentation
50	50	of a foreign birth certificate or unexpired foreign passport that
51	51	includes a certified translation if the document is not in English.
52	52	Sec. 521.114. CERTAIN APPLICATION PROVISIONS INAPPLICABLE.
53	53	Notwithstanding Section 521.101(f-3), the requirement in Section
54	54	521.101(d-1) that an applicant who is not a citizen of the United
55	55	States present to the department documentation that authorizes the
56	56	applicant to be in the United States does not apply to an
57	57	application for the issuance of a non-REAL ID personal
58	58	identification certificate.
59	59	Sec. 521.115. EXPIRATION. Notwithstanding Sections
60	60	521.101(f) and (f-1), each non-REAL ID personal identification
61	61	certificate issued or renewed under this subchapter expires one
62	62	year after the date of issuance or renewal.
63	63	SECTION 2. Section 521.421, Transportation Code, is amended
64	64	by adding Subsection (l) to read as follows:
65	65	(l) The fee for issuance or renewal of a non-REAL ID
66	66	personal identification certificate is $100.
67	67	SECTION 3. Not later than January 1, 2024, the Department of
68	68	Public Safety of the State of Texas shall adopt the rules necessary
69	69	to implement Subchapter E-1, Chapter 521, Transportation Code, as
70	70	added by this Act.
71	71	SECTION 4. This Act takes effect September 1, 2023.
