77 relating to the creation of a non-REAL ID personal identification
88 certificate; authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 521, Transportation Code, is amended by
1111 adding Subchapter E-1 to read as follows:
1212 SUBCHAPTER E-1. NON-REAL ID PERSONAL IDENTIFICATION CERTIFICATE
1313 Sec. 521.110. ELIGIBILITY. The department may issue a
1414 non-REAL ID personal identification certificate to an applicant
1515 who:
1616 (1) as of the date the certificate is issued, resides
1717 in this state; and
1818 (2) meets the requirements for the issuance of a
1919 personal identification certificate under Subchapter E other than
2020 an application requirement described by Section 521.101(d-1),
2121 521.1015(c)(1), or 521.1016(c)(1).
2222 Sec. 521.111. NOT TO BE USED AS IDENTIFICATION FOR FEDERAL
2323 OR VOTING PURPOSES. A non-REAL ID personal identification
2424 certificate issued under this subchapter is not valid as proof of
2525 the certificate holder's identity for any federal purposes or for
2626 purposes of voting in any election, including a national, state, or
2727 local election.
2828 Sec. 521.112. NON-REAL ID PERSONAL IDENTIFICATION
2929 CERTIFICATE. (a) The department shall:
3030 (1) designate and clearly mark as a non-REAL ID
3131 personal identification certificate each certificate issued under
3232 this subchapter; and
3333 (2) include on a certificate issued under this
3434 subchapter an indication that the certificate is not valid proof of
3535 identity for any federal or voting purposes.
3636 (b) Except as otherwise provided by this subchapter, the
3737 provisions of this chapter and other law applicable to the issuance
3838 or renewal of, an applicant or application for, or a holder of a
3939 personal identification certificate are applicable to the issuance
4040 or renewal of, an applicant or application for, or a holder of a
4141 non-REAL ID personal identification certificate.
4242 Sec. 521.113. RULES. (a) The department shall adopt rules
4343 to implement this subchapter, including rules:
4444 (1) regarding the design and content of the non-REAL
4545 ID personal identification certificate; and
4646 (2) establishing criteria for proof of identification
4747 and residency of an applicant.
4848 (b) Rules establishing criteria for proof of identification
4949 must allow an applicant to establish identity through presentation
5050 of a foreign birth certificate or unexpired foreign passport that
5151 includes a certified translation if the document is not in English.
5252 Sec. 521.114. CERTAIN APPLICATION PROVISIONS INAPPLICABLE.
5353 Notwithstanding Section 521.101(f-3), the requirement in Section
5454 521.101(d-1) that an applicant who is not a citizen of the United
5555 States present to the department documentation that authorizes the
5656 applicant to be in the United States does not apply to an
5757 application for the issuance of a non-REAL ID personal
5858 identification certificate.
5959 Sec. 521.115. EXPIRATION. Notwithstanding Sections
6060 521.101(f) and (f-1), each non-REAL ID personal identification
6161 certificate issued or renewed under this subchapter expires one
6262 year after the date of issuance or renewal.
6363 SECTION 2. Section 521.421, Transportation Code, is amended
6464 by adding Subsection (l) to read as follows:
6565 (l) The fee for issuance or renewal of a non-REAL ID
6666 personal identification certificate is $100.
6767 SECTION 3. Not later than January 1, 2024, the Department of
6868 Public Safety of the State of Texas shall adopt the rules necessary
6969 to implement Subchapter E-1, Chapter 521, Transportation Code, as
7070 added by this Act.
7171 SECTION 4. This Act takes effect September 1, 2023.
