55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a report by the Legislative Budget Board on the reliance
88 by this state on certain dedicated revenue for purposes of budget
99 certification.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 322.024(a), (b), and (c), Government
1212 Code, are amended to read as follows:
1313 (a) In this section, "available dedicated revenue" means
1414 revenue that Section 403.095, including any reenactment of Section
1515 403.095, makes available for certification under Section 403.121.
1616 (b) The board shall:
1717 (1) develop and implement a process to review:
1818 (A) new legislative enactments that create
1919 dedicated revenue; and
2020 (B) the appropriation and accumulation of
2121 dedicated revenue and available dedicated revenue;
2222 (2) develop and implement tools to evaluate the use of
2323 available dedicated revenue for state government financing and
2424 budgeting; and
2525 (3) develop specific and detailed recommendations on
2626 actions the legislature may reasonably take to reduce state
2727 government's reliance on available dedicated revenue for the
2828 purposes of certification under Section 403.121 as authorized by
2929 Section 403.095 or by any reenactment of Section 403.095.
3030 (c) The board shall:
3131 (1) incorporate into the board's budget
3232 recommendations for each state fiscal biennium appropriate
3333 measures to reduce state government's reliance on available
3434 dedicated revenue for the purposes of certification under Section
3535 403.121 as authorized by Section 403.095 or by any reenactment of
3636 Section 403.095; and
3737 (2) [shall] include with the budget recommendations
3838 for each state fiscal biennium a plan adopted by the board [plans]
3939 for further reducing state government's reliance on available
4040 dedicated revenue for those purposes for the three state fiscal
4141 bienniums that follow the adoption of those budget recommendations
4242 [succeeding six years].
4343 SECTION 2. This Act takes effect September 1, 2023.
