55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a health facility's removal of medical equipment from a
88 deceased individual's body before transfer to a funeral director;
99 authorizing an administrative penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 4, Health and Safety Code, is amended by
1212 adding Subtitle H to read as follows:
1313 SUBTITLE H. POWERS AND DUTIES OF HEALTH FACILITIES
1414 CHAPTER 331. GENERAL DUTIES OF HEALTH FACILITIES
1515 Sec. 331.001. REMOVAL OF MEDICAL EQUIPMENT FROM DECEASED
1616 INDIVIDUAL; ADMINISTRATIVE PENALTY. (a) In this section:
1717 (1) "Commission" means the Health and Human Services
1818 Commission.
1919 (2) "Funeral director" has the meaning assigned by
2020 Section 651.001, Occupations Code.
2121 (3) "Health facility" means a facility licensed under
2222 Subtitle B.
2323 (4) "Medical equipment" means an instrument,
2424 apparatus, implement, machine, contrivance, or other article,
2525 other than an implant, that is used in the treatment, monitoring, or
2626 diagnosis of a patient, including:
2727 (A) catheters;
2828 (B) cannulae;
2929 (C) defibrillator pads;
3030 (D) drains;
3131 (E) endotracheal tubes;
3232 (F) feeding tubes; and
3333 (G) intravascular lines.
3434 (b) If an individual dies in a health facility, the facility
3535 shall remove all medical equipment from the deceased individual's
3636 body before the body is transferred to a funeral director in
3737 accordance with Section 651.401, Occupations Code.
3838 (c) The commission shall impose an administrative penalty
3939 against a health facility that violates this section. The penalty
4040 may not exceed $500 for each violation.
4141 SECTION 2. Section 331.001, Health and Safety Code, as
4242 added by this Act, applies only to the body of an individual who
4343 dies on or after the effective date of this Act.
4444 SECTION 3. This Act takes effect September 1, 2023.
