| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 92, Property Code, is |
|---|
| 11 | 11 | | amended by adding Section 92.0115 to read as follows: |
|---|
| 12 | 12 | | Sec. 92.0115. DISCLOSURE OF CERTAIN FEES. (a) A fixed, |
|---|
| 13 | 13 | | recurring fee other than rent for a dwelling that a landlord intends |
|---|
| 14 | 14 | | to charge a tenant under a written lease must be disclosed by the |
|---|
| 15 | 15 | | landlord to the tenant before a lease for the dwelling is signed by |
|---|
| 16 | 16 | | the tenant. Disclosure of the amount of a fee in a written lease or |
|---|
| 17 | 17 | | an amendment to a written lease satisfies the requirement of this |
|---|
| 18 | 18 | | subsection. |

| 19 | 19 | | (b) A tenant is not obligated to pay a fee described by |
|---|
| 20 | 20 | | Subsection (a) that is not disclosed as required by that |
|---|
| 21 | 21 | | subsection. |
|---|
| 22 | 22 | | (c) Nothing in this section may be construed to limit the |
|---|
| 23 | 23 | | ability of a landlord and tenant to enter into an agreement during a |
|---|
| 24 | 24 | | lease term under which the landlord charges a recurring fee to the |
|---|
| 25 | 25 | | tenant for goods or services. |
|---|
| 26 | 26 | | SECTION 2. Section 92.0115, Property Code, as added by this |
|---|
| 27 | 27 | | Act, applies only to a fee under a lease entered into or renewed on |
|---|
| 28 | 28 | | or after the effective date of this Act. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
