| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 202.010(a)(2), Property Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (2) "Solar energy device" has the meaning assigned by |
|---|
| 13 | 13 | | Section 171.107, Tax Code. The term includes a solar roof tile. |

| 14 | 14 | | SECTION 2. The amendment by this Act of Section |
|---|
| 15 | 15 | | 202.010(a)(2), Property Code, is intended to clarify rather than |
|---|
| 16 | 16 | | change existing law. |
|---|
| 17 | 17 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 18 | 18 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 19 | 19 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 20 | 20 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 21 | 21 | | Act takes effect September 1, 2023. |
