| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 135.02(a), Education Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (a) The Texas State Technical College System is composed of: |
|---|
| 11 | 11 | | (1) a system office located in the city of Waco in |
|---|
| 12 | 12 | | McLennan County; |
|---|
| 13 | 13 | | (2) a campus located in [the city of Harlingen in] |
|---|
| 14 | 14 | | Cameron County; |
|---|
| 15 | 15 | | (3) a campus serving West Texas that operates as a |
|---|
| 16 | 16 | | collective unit of strategically positioned permanent locations in |
|---|
| 17 | 17 | | [the city of Sweetwater in] Nolan County, [the city of Abilene in] |
|---|
| 18 | 18 | | Taylor County, [the city of Brownwood in] Brown County, and [the |
|---|
| 19 | 19 | | city of Breckenridge in] Stephens County; |
|---|
| 20 | 20 | | (4) a campus located [in the city of Marshall] in |
|---|
| 21 | 21 | | Harrison County; |
|---|
| 22 | 22 | | (5) a campus located [in the city of Waco] in McLennan |
|---|
| 23 | 23 | | County; |
|---|
| 24 | 24 | | (6) a campus located in Fort Bend County; |
|---|
| 25 | 25 | | (7) a campus that operates as a collective unit of one |
|---|
| 26 | 26 | | or more locations [located in the city of Red Oak] in Ellis County; |
|---|
| 27 | 27 | | [and] |
|---|
| 28 | 28 | | (8) a campus that operates as a collective unit of one |
|---|
| 29 | 29 | | or more locations in Comal County and Guadalupe County; |
|---|
| 30 | 30 | | (9) a campus located in Denton County; |
|---|
| 31 | 31 | | (10) a campus that operates as a collective unit of one |
|---|
| 32 | 32 | | or more locations in Williamson County east of State Highway 130 and |
|---|
| 33 | 33 | | Interstate Highway 35; and |
|---|
| 34 | 34 | | (11) campuses assigned to the system from time to time |
|---|
| 35 | 35 | | by specific legislative Act. |
|---|
| 36 | 36 | | SECTION 2. Section 130.063(e), Education Code, is amended |
|---|
| 37 | 37 | | to read as follows: |
|---|
| 38 | 38 | | (e) This section does not prevent a junior college district |
|---|
| 39 | 39 | | from annexing territory located in Brown County, Comal County, |
|---|
| 40 | 40 | | Denton County, Guadalupe County, or Williamson County. |
|---|
| 41 | 41 | | SECTION 3. Section 135.04(b), Education Code, is amended to |
|---|
| 42 | 42 | | read as follows: |
|---|
| 43 | 43 | | (b) Before any program may be offered by a campus or |
|---|
| 44 | 44 | | extension center within the tax district of a public junior college |
|---|
| 45 | 45 | | that is operating a vocational and technical program, it must be |
|---|
| 46 | 46 | | established that the public junior college is not capable of |
|---|
| 47 | 47 | | offering or is unable to offer the program. After it is established |
|---|
| 48 | 48 | | that a need for the program exists and that the program is not |
|---|
| 49 | 49 | | locally available, the campus or extension center may offer the |
|---|
| 50 | 50 | | program, provided approval is secured from the coordinating board. |
|---|
| 51 | 51 | | Approval of technical-vocational programs under this section does |
|---|
| 52 | 52 | | not apply to Brown, McLennan, Cameron, Fort Bend, Comal, Denton, |
|---|
| 53 | 53 | | Guadalupe, Williamson, and Potter Counties [counties]. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2023. |
