6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 7 | | SECTION 1. Section 771.0713, Health and Safety Code, is |
---|
8 | 8 | | amended by amending Subsections (b), (f), and (g) and adding |
---|
9 | 9 | | Subsections (c-1), (c-2), and (c-3) to read as follows: |
---|
10 | 10 | | (b) Notwithstanding any other law and except as provided by |
---|
11 | 11 | | federal law, the comptroller shall transfer to the credit of the |
---|
12 | 12 | | next generation 9-1-1 service fund any amount available from |
---|
13 | 13 | | federal money provided to this state from the Coronavirus State and |
---|
14 | 14 | | Local Fiscal Recovery Funds under Section 9901 of the American |
---|
15 | 15 | | Rescue Plan Act of 2021 (Pub. L. No. 117-2) or from any other state |
---|
16 | 16 | | or federal governmental source for purposes of this chapter, |
---|
17 | 17 | | including money appropriated or otherwise credited to the fund. |
---|
18 | 18 | | The comptroller shall transfer the money as soon as practicable |
---|
19 | 19 | | following: |
---|
20 | 20 | | (1) the receipt by this state of a sufficient amount of |
---|
21 | 21 | | federal money for the transfer; or |
---|
22 | 22 | | (2) the effective date of the most recent legislative |
---|
23 | 23 | | appropriation for purposes of this chapter. |
---|
24 | 24 | | (c-1) Except as provided by Subsection (c-2), the |
---|
25 | 25 | | commission shall distribute from money appropriated to the |
---|
26 | 26 | | commission for purposes of this chapter to each emergency |
---|
27 | 27 | | communications district that does not participate in the state |
---|
28 | 28 | | system a portion of the appropriated money in an amount |
---|
29 | 29 | | proportional to the population of the area served by the district |
---|
30 | 30 | | compared to the population of this state. |
---|
31 | 31 | | (c-2) For each emergency communication district created |
---|
32 | 32 | | under Chapter 772 that is entitled to a portion of the money |
---|
33 | 33 | | distributed under Subsection (c-1), the commission shall: |
---|
34 | 34 | | (1) reduce the portion to which that district is |
---|
35 | 35 | | entitled by an amount equal to nine percent of that portion and |
---|
36 | 36 | | distribute that resulting amount in equal shares to all the |
---|
37 | 37 | | emergency communication districts created under Chapter 772; and |
---|
38 | 38 | | (2) distribute to that district the remainder of the |
---|
39 | 39 | | portion to which the district is entitled under Subsection (c-1) |
---|
40 | 40 | | that is not distributed under Subdivision (1). |
---|
41 | 41 | | (c-3) The remaining money appropriated to the commission |
---|
42 | 42 | | for purposes of this chapter that is not otherwise distributed |
---|
43 | 43 | | under Subsection (c-1) or (c-2) shall be deposited to the 9-1-1 |
---|
44 | 44 | | services fee account. |
---|
45 | 45 | | (f) All money in the fund from the Coronavirus State and |
---|
46 | 46 | | Local Fiscal Recovery Funds under Section 9901 of the American |
---|
47 | 47 | | Rescue Plan Act of 2021 (Pub. L. No. 117-2) shall be distributed in |
---|
48 | 48 | | accordance with this section not later than August 31, 2024 |
---|
49 | 49 | | [December 31, 2022], and all money distributed under this section |
---|
50 | 50 | | from the Coronavirus State and Local Fiscal Recovery Funds under |
---|
51 | 51 | | Section 9901 of the American Rescue Plan Act of 2021 (Pub. L. |
---|
52 | 52 | | No. 117-2) shall be spent not later than December 31, 2026 [2024], |
---|
53 | 53 | | for the deployment and reliable operation of next generation 9-1-1 |
---|
54 | 54 | | service. |
---|
55 | 55 | | (g) This section expires December 31, 2028 [September 1, |
---|
56 | 56 | | 2025]. |
---|
57 | 57 | | SECTION 2. Section 771.079(b), Health and Safety Code, is |
---|
58 | 58 | | amended to read as follows: |
---|
59 | 59 | | (b) The account consists of: |
---|
60 | 60 | | (1) fees deposited in the fund as provided by Sections |
---|
61 | 61 | | 771.071 and 771.0711; [and] |
---|
62 | 62 | | (2) money deposited to the account under Section |
---|
63 | 63 | | 771.0713(c-3); and |
---|
64 | 64 | | (3) notwithstanding Section 404.071, Government Code, |
---|
65 | 65 | | all interest attributable to money held in the account. |
---|
66 | 66 | | SECTION 3. The changes in law made by this Act apply |
---|
67 | 67 | | beginning with the state fiscal biennium that begins September 1, |
---|
68 | 68 | | 2023. |
---|
69 | 69 | | SECTION 4. This Act takes effect September 1, 2023. |
---|
