55 relating to the next generation 9-1-1 service fund.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 771.0713, Health and Safety Code, is
88 amended by amending Subsections (b), (f), and (g) and adding
99 Subsections (c-1), (c-2), and (c-3) to read as follows:
1010 (b) Notwithstanding any other law and except as provided by
1111 federal law, the comptroller shall transfer to the credit of the
1212 next generation 9-1-1 service fund any amount available from
1313 federal money provided to this state from the Coronavirus State and
1414 Local Fiscal Recovery Funds under Section 9901 of the American
1515 Rescue Plan Act of 2021 (Pub. L. No. 117-2) or from any other state
1616 or federal governmental source for purposes of this chapter,
1717 including money appropriated or otherwise credited to the fund.
1818 The comptroller shall transfer the money as soon as practicable
1919 following:
2020 (1) the receipt by this state of a sufficient amount of
2121 federal money for the transfer; or
2222 (2) the effective date of the most recent legislative
2323 appropriation for purposes of this chapter.
2424 (c-1) Except as provided by Subsection (c-2), the
2525 commission shall distribute from money appropriated to the
2626 commission for purposes of this chapter to each emergency
2727 communications district that does not participate in the state
2828 system a portion of the appropriated money in an amount
2929 proportional to the population of the area served by the district
3030 compared to the population of this state.
3131 (c-2) For each emergency communication district created
3232 under Chapter 772 that is entitled to a portion of the money
3333 distributed under Subsection (c-1), the commission shall:
3434 (1) reduce the portion to which that district is
3535 entitled by an amount equal to nine percent of that portion and
3636 distribute that resulting amount in equal shares to all the
3737 emergency communication districts created under Chapter 772; and
3838 (2) distribute to that district the remainder of the
3939 portion to which the district is entitled under Subsection (c-1)
4040 that is not distributed under Subdivision (1).
4141 (c-3) The remaining money appropriated to the commission
4242 for purposes of this chapter that is not otherwise distributed
4343 under Subsection (c-1) or (c-2) shall be deposited to the 9-1-1
4444 services fee account.
4545 (f) All money in the fund from the Coronavirus State and
4646 Local Fiscal Recovery Funds under Section 9901 of the American
4747 Rescue Plan Act of 2021 (Pub. L. No. 117-2) shall be distributed in
4848 accordance with this section not later than August 31, 2024
4949 [December 31, 2022], and all money distributed under this section
5050 from the Coronavirus State and Local Fiscal Recovery Funds under
5151 Section 9901 of the American Rescue Plan Act of 2021 (Pub. L.
5252 No. 117-2) shall be spent not later than December 31, 2026 [2024],
5353 for the deployment and reliable operation of next generation 9-1-1
5454 service.
5555 (g) This section expires December 31, 2028 [September 1,
5656 2025].
5757 SECTION 2. Section 771.079(b), Health and Safety Code, is
5858 amended to read as follows:
5959 (b) The account consists of:
6060 (1) fees deposited in the fund as provided by Sections
6161 771.071 and 771.0711; [and]
6262 (2) money deposited to the account under Section
6363 771.0713(c-3); and
6464 (3) notwithstanding Section 404.071, Government Code,
6565 all interest attributable to money held in the account.
6666 SECTION 3. The changes in law made by this Act apply
6767 beginning with the state fiscal biennium that begins September 1,
6868 2023.
6969 SECTION 4. This Act takes effect September 1, 2023.
