88 AN ACT
99 relating to reporting requirements regarding certain data related
1010 to students at two-year public institutions of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 2308A, Government Code, is amended by
1313 adding Section 2308A.0091 to read as follows:
1414 Sec. 2308A.0091. ANNUAL REPORT REGARDING TWO-YEAR
1515 INSTITUTION OF HIGHER EDUCATION EMPLOYMENT AND WAGE OUTCOMES. (a)
1616 In this section:
1717 (1) "Average first-year wages" means the average
1818 annual wages earned by a yearly cohort's graduates and leavers
1919 during the first calendar year following the calendar year in which
2020 those persons graduated from or were last enrolled in the
2121 applicable two-year institution of higher education.
2222 (2) "Graduate" means a person who:
2323 (A) has been awarded a degree or certificate from
2424 a two-year institution of higher education; and
2525 (B) is not determined by the coordinating board
2626 for purposes of this section to be enrolled in another institution
2727 of higher education.
2828 (3) "Leaver" means a student who:
2929 (A) has completed at least nine semester credit
3030 hours or the equivalent at a two-year institution of higher
3131 education;
3232 (B) is no longer enrolled at the institution but
3333 did not graduate; and
3434 (C) is not determined by the coordinating board
3535 for purposes of this section to be enrolled in another institution
3636 of higher education.
3737 (4) "Placement rate" in regard to a yearly cohort
3838 means the proportion of the yearly cohort's graduates and leavers
3939 determined by the coordinating board to be working in this state
4040 during the first calendar year following the calendar year in which
4141 the yearly cohort's members graduated from or were last enrolled in
4242 the applicable two-year institution of higher education, expressed
4343 as a percentage.
4444 (5) "Transfer rate" in regard to an institution's
4545 yearly cohort means the proportion of the yearly cohort's members
4646 who are no longer enrolled in the institution but did not graduate
4747 and are determined by the coordinating board for purposes of this
4848 section to be enrolled in another institution of higher education.
4949 (6) "Two-year institution of higher education" has the
5050 meaning assigned by Section 54.751, Education Code.
5151 (7) "Yearly cohort" means a cohort of students from a
5252 two-year institution of higher education that includes, for a
5353 calendar year, each:
5454 (A) graduate who graduated from the institution
5555 during that calendar year;
5656 (B) leaver who last enrolled in the institution
5757 during that calendar year; and
5858 (C) student who last enrolled in the institution
5959 during that calendar year but did not graduate and is determined by
6060 the coordinating board for purposes of this section to be enrolled
6161 in another institution of higher education.
6262 (b) Not later than March 31 of each calendar year, the
6363 coordinating board shall:
6464 (1) determine, in consultation with the commission,
6565 the most recent calendar year for which the entire calendar year's
6666 unemployment insurance wage record data may be obtained from the
6767 commission;
6868 (2) obtain from the commission the unemployment
6969 insurance wage record data for the calendar year identified in
7070 Subdivision (1);
7171 (3) collate the unemployment insurance wage record
7272 data obtained under Subdivision (2) using the social security
7373 numbers for graduates and leavers in each two-year institution of
7474 higher education's yearly cohort for the calendar year immediately
7575 preceding the calendar year for which the unemployment insurance
7676 wage record data was obtained;
7777 (4) use the unemployment insurance wage record data
7878 collated under Subdivision (3) to determine the average first-year
7979 wages and placement rate for each yearly cohort described by
8080 Subdivision (3); and
8181 (5) using enrollment data from all institutions of
8282 higher education, determine the transfer rate for each yearly
8383 cohort described by Subdivision (3).
8484 (c) Not later than the first Monday of April of each year,
8585 the coordinating board shall submit a report to each member of the
8686 legislature, the lieutenant governor, the governor, the
8787 comptroller, and the chief executive officer of each two-year
8888 institution of higher education. The report must contain the most
8989 recently available average first-year wages, placement rate, and
9090 transfer rate of each two-year institution of higher education, as
9191 determined by the coordinating board under Subsection (b).
9292 (d) The coordinating board shall:
9393 (1) maintain copies of each report submitted under
9494 Subsection (c) in a manner that is accessible for public
9595 inspection; and
9696 (2) on the person's request, provide a copy of a report
9797 maintained under Subdivision (1) to a member of the legislature,
9898 the lieutenant governor, the governor, the comptroller, or the
9999 chief executive officer of a two-year institution of higher
100100 education.
101101 (e) The coordinating board may adopt rules as necessary for
102102 the administration of this section.
103103 SECTION 2. Section 130.0035(b), Education Code, is amended
104104 to read as follows:
105105 (b) The report must include the following information for
106106 the junior college district for the academic year covered by the
107107 report:
108108 (1) the rate at which students completed courses
109109 attempted;
110110 (2) the number and types of degrees and certificates
111111 awarded;
112112 (3) the percentage of graduates who passed licensing
113113 exams related to the degree or certificate awarded, to the extent
114114 the information can be determined;
115115 (4) the number of students or graduates who transfer
116116 to or are admitted to a public university;
117117 (5) the passing rates for students required to be
118118 tested under former Section 51.306;
119119 (6) the percentage of students enrolled who are
120120 academically disadvantaged;
121121 (7) the percentage of students enrolled who are
122122 economically disadvantaged;
123123 (8) the racial and ethnic composition of the
124124 district's student body; [and]
125125 (9) the percentage of student contact hours taught by
126126 full-time faculty; and
127127 (10) the most recent average first-year wages,
128128 placement rate, and transfer rate for the district's students
129129 reported by the Texas Higher Education Coordinating Board in the
130130 coordinating board's most recent report under Section 2308A.0091,
131131 Government Code.
132132 SECTION 3. This Act takes effect September 1, 2023.
