8	8	AN ACT
9	9	relating to reporting requirements regarding certain data related
10	10	to students at two-year public institutions of higher education.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Chapter 2308A, Government Code, is amended by
13	13	adding Section 2308A.0091 to read as follows:
14	14	Sec. 2308A.0091. ANNUAL REPORT REGARDING TWO-YEAR
15	15	INSTITUTION OF HIGHER EDUCATION EMPLOYMENT AND WAGE OUTCOMES. (a)
16	16	In this section:
17	17	(1) "Average first-year wages" means the average
18	18	annual wages earned by a yearly cohort's graduates and leavers
19	19	during the first calendar year following the calendar year in which
20	20	those persons graduated from or were last enrolled in the
21	21	applicable two-year institution of higher education.
22	22	(2) "Graduate" means a person who:
23	23	(A) has been awarded a degree or certificate from
24	24	a two-year institution of higher education; and
25	25	(B) is not determined by the coordinating board
26	26	for purposes of this section to be enrolled in another institution
27	27	of higher education.
28	28	(3) "Leaver" means a student who:
29	29	(A) has completed at least nine semester credit
30	30	hours or the equivalent at a two-year institution of higher
31	31	education;
32	32	(B) is no longer enrolled at the institution but
33	33	did not graduate; and
34	34	(C) is not determined by the coordinating board
35	35	for purposes of this section to be enrolled in another institution
36	36	of higher education.
37	37	(4) "Placement rate" in regard to a yearly cohort
38	38	means the proportion of the yearly cohort's graduates and leavers
39	39	determined by the coordinating board to be working in this state
40	40	during the first calendar year following the calendar year in which
41	41	the yearly cohort's members graduated from or were last enrolled in
42	42	the applicable two-year institution of higher education, expressed
43	43	as a percentage.
44	44	(5) "Transfer rate" in regard to an institution's
45	45	yearly cohort means the proportion of the yearly cohort's members
46	46	who are no longer enrolled in the institution but did not graduate
47	47	and are determined by the coordinating board for purposes of this
48	48	section to be enrolled in another institution of higher education.
49	49	(6) "Two-year institution of higher education" has the
50	50	meaning assigned by Section 54.751, Education Code.
51	51	(7) "Yearly cohort" means a cohort of students from a
52	52	two-year institution of higher education that includes, for a
53	53	calendar year, each:
54	54	(A) graduate who graduated from the institution
55	55	during that calendar year;
56	56	(B) leaver who last enrolled in the institution
57	57	during that calendar year; and
58	58	(C) student who last enrolled in the institution
59	59	during that calendar year but did not graduate and is determined by
60	60	the coordinating board for purposes of this section to be enrolled
61	61	in another institution of higher education.
62	62	(b) Not later than March 31 of each calendar year, the
63	63	coordinating board shall:
64	64	(1) determine, in consultation with the commission,
65	65	the most recent calendar year for which the entire calendar year's
66	66	unemployment insurance wage record data may be obtained from the
67	67	commission;
68	68	(2) obtain from the commission the unemployment
69	69	insurance wage record data for the calendar year identified in
70	70	Subdivision (1);
71	71	(3) collate the unemployment insurance wage record
72	72	data obtained under Subdivision (2) using the social security
73	73	numbers for graduates and leavers in each two-year institution of
74	74	higher education's yearly cohort for the calendar year immediately
75	75	preceding the calendar year for which the unemployment insurance
76	76	wage record data was obtained;
77	77	(4) use the unemployment insurance wage record data
78	78	collated under Subdivision (3) to determine the average first-year
79	79	wages and placement rate for each yearly cohort described by
80	80	Subdivision (3); and
81	81	(5) using enrollment data from all institutions of
82	82	higher education, determine the transfer rate for each yearly
83	83	cohort described by Subdivision (3).
84	84	(c) Not later than the first Monday of April of each year,
85	85	the coordinating board shall submit a report to each member of the
86	86	legislature, the lieutenant governor, the governor, the
87	87	comptroller, and the chief executive officer of each two-year
88	88	institution of higher education. The report must contain the most
89	89	recently available average first-year wages, placement rate, and
90	90	transfer rate of each two-year institution of higher education, as
91	91	determined by the coordinating board under Subsection (b).
92	92	(d) The coordinating board shall:
93	93	(1) maintain copies of each report submitted under
94	94	Subsection (c) in a manner that is accessible for public
95	95	inspection; and
96	96	(2) on the person's request, provide a copy of a report
97	97	maintained under Subdivision (1) to a member of the legislature,
98	98	the lieutenant governor, the governor, the comptroller, or the
99	99	chief executive officer of a two-year institution of higher
100	100	education.
101	101	(e) The coordinating board may adopt rules as necessary for
102	102	the administration of this section.
103	103	SECTION 2. Section 130.0035(b), Education Code, is amended
104	104	to read as follows:
105	105	(b) The report must include the following information for
106	106	the junior college district for the academic year covered by the
107	107	report:
108	108	(1) the rate at which students completed courses
109	109	attempted;
110	110	(2) the number and types of degrees and certificates
111	111	awarded;
112	112	(3) the percentage of graduates who passed licensing
113	113	exams related to the degree or certificate awarded, to the extent
114	114	the information can be determined;
115	115	(4) the number of students or graduates who transfer
116	116	to or are admitted to a public university;
117	117	(5) the passing rates for students required to be
118	118	tested under former Section 51.306;
119	119	(6) the percentage of students enrolled who are
120	120	academically disadvantaged;
121	121	(7) the percentage of students enrolled who are
122	122	economically disadvantaged;
123	123	(8) the racial and ethnic composition of the
124	124	district's student body; [and]
125	125	(9) the percentage of student contact hours taught by
126	126	full-time faculty; and
127	127	(10) the most recent average first-year wages,
128	128	placement rate, and transfer rate for the district's students
129	129	reported by the Texas Higher Education Coordinating Board in the
130	130	coordinating board's most recent report under Section 2308A.0091,
131	131	Government Code.
132	132	SECTION 3. This Act takes effect September 1, 2023.
