66 AN ACT
77 relating to requiring the disclosure of taxes and fees charged for
88 the sale of concert and other event tickets.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 6, Business & Commerce Code, is amended by
1111 adding Chapter 205 to read as follows:
1212 CHAPTER 205. DISCLOSURE OF TAXES AND FEES FOR EVENT TICKETS
1313 Sec. 205.001. DEFINITIONS. In this chapter:
1414 (1) "Event" means a concert, theatrical performance,
1515 sporting event, exhibition, show, or similar scheduled activity
1616 that:
1717 (A) is open to the public;
1818 (B) is held in a public or private venue; and
1919 (C) requires payment of an admission fee to
2020 attend the activity.
2121 (2) "Ticket website" means an Internet website or
2222 mobile application advertising or offering the sale of tickets, or
2323 offering tickets for resale, to an event in this state.
2424 (3) "Venue" means an arena, stadium, theater, concert
2525 hall, or other place used for events.
2626 Sec. 205.002. DISCLOSURE OF TAXES AND FEES. A person that
2727 sells or resells tickets for a concert or other event in this state,
2828 including the operator of a ticket website, must disclose all taxes
2929 and fees charged in connection with the sale of a ticket for the
3030 event. The total price of event tickets made available for sale on
3131 a ticket website, including taxes and fees charged in connection
3232 with the sale, must be posted on the website in a location easily
3333 accessible by ticket purchasers or potential ticket purchasers.
3434 SECTION 2. This Act takes effect September 1, 2023.
