66 AN ACT
77 relating to regulation of residential wind power facilities by
88 property owners' associations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 202, Property Code, is amended by adding
1111 Section 202.024 to read as follows:
1212 Sec. 202.024. REGULATION OF RESIDENTIAL WIND POWER
1313 FACILITIES. (a) In this section:
1414 (1) "Development period" and "residential unit" have
1515 the meanings assigned by Section 202.010.
1616 (2) "Wind power facility" has the meaning assigned by
1717 Section 301.0001, Utilities Code.
1818 (b) Except as otherwise provided by Subsection (d), a
1919 property owners' association may not include or enforce a provision
2020 in a dedicatory instrument that prohibits or restricts a property
2121 owner from installing a wind power facility of an appropriate
2222 residential scale.
2323 (c) A provision that violates Subsection (b) is void.
2424 (d) A property owners' association may include or enforce a
2525 provision in a dedicatory instrument that prohibits a wind power
2626 facility that:
2727 (1) as adjudicated by a court:
2828 (A) threatens the public health or safety; or
2929 (B) violates a law;
3030 (2) is located on property owned or maintained by the
3131 property owners' association;
3232 (3) is located on property owned in common by the
3333 members of the property owners' association;
3434 (4) is located in an area on the property owner's
3535 property other than an area designated by the property owners'
3636 association, unless the alternate location increases the estimated
3737 annual energy production of the facility, as determined by using a
3838 publicly available modeling tool provided by the National Renewable
3939 Energy Laboratory, by more than 10 percent above the energy
4040 production of the facility if located in an area designated by the
4141 property owners' association;
4242 (5) as installed, voids material warranties; or
4343 (6) was installed without prior approval by the
4444 property owners' association or by a committee created in a
4545 dedicatory instrument for such purposes that provides decisions
4646 within a reasonable period or within a period specified in the
4747 dedicatory instrument.
4848 (e) A property owners' association or the association's
4949 architectural review committee may not withhold approval for
5050 installation of a wind power facility if the provisions of the
5151 dedicatory instruments to the extent authorized by Subsection (d)
5252 are met or exceeded, unless the association or committee, as
5353 applicable, determines in writing that placement of the facility as
5454 proposed by the property owner constitutes a condition that
5555 substantially interferes with the use and enjoyment of land by
5656 causing unreasonable discomfort or annoyance to persons of ordinary
5757 sensibilities. For purposes of making a determination under this
5858 subsection, the written approval of the proposed placement of the
5959 facility by all property owners of adjoining property constitutes
6060 prima facie evidence that such a condition does not exist.
6161 (f) During the development period for a development with
6262 fewer than 51 planned residential units, the declarant may prohibit
6363 or restrict a property owner from installing a wind power facility.
6464 SECTION 2. This Act takes effect September 1, 2023.
