| 7 | 7 | | relating to a study by the Texas Education Agency on the |

| 8 | 8 | | administration of assessment instruments in Spanish to certain |
|---|
| 9 | 9 | | public school students in grades six through 12. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 39, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 39.02303 to read as follows: |
|---|
| 13 | 13 | | Sec. 39.02303. STUDY ON ADMINISTRATION OF CERTAIN |
|---|
| 14 | 14 | | ASSESSMENT INSTRUMENTS IN SPANISH. (a) In this section, "emergent |
|---|
| 15 | 15 | | bilingual student" has the meaning assigned by Section 29.052. |
|---|
| 16 | 16 | | (b) The agency shall conduct a study regarding the |
|---|
| 17 | 17 | | feasibility of administering assessment instruments adopted under |
|---|
| 18 | 18 | | Section 39.023 and administered to students in grades six through |
|---|
| 19 | 19 | | 12 in Spanish for emergent bilingual students whose primary |
|---|
| 20 | 20 | | language is Spanish. |
|---|
| 21 | 21 | | (c) The study must include research regarding how to |
|---|
| 22 | 22 | | administer the assessment instrument in a manner that allows, to |
|---|
| 23 | 23 | | the extent practicable, the score an emergent bilingual student |
|---|
| 24 | 24 | | receives on the assessment instrument to be statistically useful |
|---|
| 25 | 25 | | for comparison, considering the limited number of emergent |
|---|
| 26 | 26 | | bilingual students, to performance by students administered the |
|---|
| 27 | 27 | | same instrument in English. |
|---|
| 28 | 28 | | (d) Not later than December 1, 2024, the agency shall |
|---|
| 29 | 29 | | prepare and submit to the legislature a report on the results of the |
|---|
| 30 | 30 | | study and any recommendations for legislative or other action. |
|---|
| 31 | 31 | | (e) This section expires September 1, 2025. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2023. |
