| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 21, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 21.04892 to read as follows: |
|---|
| 12 | 12 | | Sec. 21.04892. DUAL LANGUAGE IMMERSION BILINGUAL EDUCATION |
|---|
| 13 | 13 | | CERTIFICATION. (a) The board shall establish a dual language |
|---|
| 14 | 14 | | immersion bilingual education teaching certificate to provide |
|---|
| 15 | 15 | | instruction to high school students in bilingual education programs |
|---|
| 16 | 16 | | using a dual language immersion/one-way or two-way program model. |
|---|
| 17 | 17 | | (b) To be eligible for a certificate established under this |
|---|
| 18 | 18 | | section, a person must: |
|---|
| 19 | 19 | | (1) satisfactorily complete the coursework for that |
|---|
| 20 | 20 | | certificate in an educator preparation program; |
|---|
| 21 | 21 | | (2) perform satisfactorily on the Bilingual Target |
|---|
| 22 | 22 | | Language Proficiency Test; and |
|---|
| 23 | 23 | | (3) satisfy any other requirements prescribed by the |
|---|
| 24 | 24 | | board designed to address specific linguistic and content |
|---|
| 25 | 25 | | requirements for effective instruction in a dual language immersion |
|---|
| 26 | 26 | | program. |
|---|
| 27 | 27 | | (c) The board shall propose rules to allow a person seeking |
|---|
| 28 | 28 | | certification under this section who fails to perform |
|---|
| 29 | 29 | | satisfactorily on the Bilingual Target Language Proficiency Test |
|---|
| 30 | 30 | | to: |
|---|
| 31 | 31 | | (1) retake only the sections of the test that include |
|---|
| 32 | 32 | | the domains on which the person failed to perform satisfactorily; |
|---|
| 33 | 33 | | and |
|---|
| 34 | 34 | | (2) during a retake of the test described by |
|---|
| 35 | 35 | | Subdivision (1), demonstrate the person's language proficiency |
|---|
| 36 | 36 | | through the completion of fewer components, including eliminating a |
|---|
| 37 | 37 | | component that requires the preparation of a lesson plan for a |
|---|
| 38 | 38 | | person who fails to perform satisfactorily on a domain requiring |
|---|
| 39 | 39 | | completion of that component. |
|---|
| 40 | 40 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 41 | 41 | | of this Act, the State Board for Educator Certification shall |
|---|
| 42 | 42 | | propose rules prescribing requirements for an educator |
|---|
| 43 | 43 | | certification in dual language immersion bilingual education |
|---|
| 44 | 44 | | teaching as provided by Section 21.04892, Education Code, as added |
|---|
| 45 | 45 | | by this Act. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect September 1, 2023. |
