7 | 7 | | relating to a study by the Texas Education Agency on the |

8 | 8 | | administration of assessment instruments in Spanish to certain |
---|
9 | 9 | | public school students in grades six through eight. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 39, Education Code, is |
---|
12 | 12 | | amended by adding Section 39.02303 to read as follows: |
---|
13 | 13 | | Sec. 39.02303. STUDY ON ADMINISTRATION OF CERTAIN |
---|
14 | 14 | | ASSESSMENT INSTRUMENTS IN SPANISH. (a) In this section, "emergent |
---|
15 | 15 | | bilingual student" has the meaning assigned by Section 29.052. |
---|
16 | 16 | | (b) The agency shall conduct a study regarding the |
---|
17 | 17 | | feasibility of administering assessment instruments adopted under |
---|
18 | 18 | | Section 39.023 and administered to students in grades six through |
---|
19 | 19 | | eight in Spanish for emergent bilingual students whose primary |
---|
20 | 20 | | language is Spanish. |
---|
21 | 21 | | (c) The study must: |
---|
22 | 22 | | (1) examine the extent to which not administering |
---|
23 | 23 | | assessment instruments adopted under Section 39.023 in Spanish to |
---|
24 | 24 | | emergent bilingual students in grades six through eight whose |
---|
25 | 25 | | primary language is Spanish limits the implementation of dual |
---|
26 | 26 | | language immersion/one-way and two-way program models in secondary |
---|
27 | 27 | | schools; |
---|
28 | 28 | | (2) include research regarding how to administer an |
---|
29 | 29 | | assessment instrument described by Subdivision (1) in a manner that |
---|
30 | 30 | | allows, to the extent practicable, the score an emergent bilingual |
---|
31 | 31 | | student receives on the assessment instrument to be statistically |
---|
32 | 32 | | useful for comparison, considering the limited number of emergent |
---|
33 | 33 | | bilingual students, to performance by students administered the |
---|
34 | 34 | | same instrument in English; and |
---|
35 | 35 | | (3) identify and develop a list of nationally |
---|
36 | 36 | | recognized norm-referenced assessment instruments available for |
---|
37 | 37 | | administration in Spanish to students enrolled in dual language |
---|
38 | 38 | | immersion/one-way and two-way programs. |
---|
39 | 39 | | (d) Not later than December 1, 2024, the agency shall |
---|
40 | 40 | | prepare and submit to the legislature a report on the results of the |
---|
41 | 41 | | study and any recommendations for legislative or other action. |
---|
42 | 42 | | (e) This section expires September 1, 2025. |
---|
43 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2023. |
