55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study by the Texas Education Agency on the
88 administration of assessment instruments in Spanish to certain
99 public school students in grades six through eight.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 39, Education Code, is
1212 amended by adding Section 39.02303 to read as follows:
1313 Sec. 39.02303. STUDY ON ADMINISTRATION OF CERTAIN
1414 ASSESSMENT INSTRUMENTS IN SPANISH. (a) In this section, "emergent
1515 bilingual student" has the meaning assigned by Section 29.052.
1616 (b) The agency shall conduct a study regarding the
1717 feasibility of administering assessment instruments adopted under
1818 Section 39.023 and administered to students in grades six through
1919 eight in Spanish for emergent bilingual students whose primary
2020 language is Spanish.
2121 (c) The study must:
2222 (1) examine the extent to which not administering
2323 assessment instruments adopted under Section 39.023 in Spanish to
2424 emergent bilingual students in grades six through eight whose
2525 primary language is Spanish limits the implementation of dual
2626 language immersion/one-way and two-way program models in secondary
2727 schools;
2828 (2) include research regarding how to administer an
2929 assessment instrument described by Subdivision (1) in a manner that
3030 allows, to the extent practicable, the score an emergent bilingual
3131 student receives on the assessment instrument to be statistically
3232 useful for comparison, considering the limited number of emergent
3333 bilingual students, to performance by students administered the
3434 same instrument in English; and
3535 (3) identify and develop a list of nationally
3636 recognized norm-referenced assessment instruments available for
3737 administration in Spanish to students enrolled in dual language
3838 immersion/one-way and two-way programs.
3939 (d) Not later than December 1, 2024, the agency shall
4040 prepare and submit to the legislature a report on the results of the
4141 study and any recommendations for legislative or other action.
4242 (e) This section expires September 1, 2025.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2023.
