| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.105(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) For each student in average daily attendance in a |
|---|
| 13 | 13 | | bilingual education or special language program under Subchapter B, |
|---|
| 14 | 14 | | Chapter 29, a district is entitled to an annual allotment equal to |
|---|
| 15 | 15 | | the basic allotment multiplied by: |
|---|
| 16 | 16 | | (1) for an emergent bilingual student, as defined by |
|---|
| 17 | 17 | | Section 29.052: |
|---|
| 18 | 18 | | (A) 0.1; or |
|---|
| 19 | 19 | | (B) 0.15 if the student is in a bilingual |
|---|
| 20 | 20 | | education program using a dual language immersion/one-way or |
|---|
| 21 | 21 | | two-way program model; and |
|---|
| 22 | 22 | | (2) for a student not described by Subdivision (1), |
|---|
| 23 | 23 | | 0.05 if the student is in a bilingual education program using a dual |
|---|
| 24 | 24 | | language immersion/one-way or two-way [immersion/two-way] program |
|---|
| 25 | 25 | | model. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
