88 nonpayment of rent.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 24, Property Code, is amended by adding
1111 Section 24.00605 to read as follows:
1212 Sec. 24.00605. RESIDENTIAL TENANT'S RIGHT TO CURE BEFORE
1313 JUDGMENT RENDERED. (a) Except as provided by Subsection (b), a
1414 residential tenant who is in default for nonpayment of rent under a
1515 written or oral lease may cure the default and reinstate the lease
1616 by paying all rent, court costs, and attorney's fees at any time
1717 before the date that a court renders judgment against the tenant in
1818 an eviction suit.
1919 (b) Unless the lease provides otherwise, a tenant may not
2020 cure a default if the tenant cured a default under this section in
2121 the preceding 12-month period.
2222 SECTION 2. The changes in law made by this Act apply only to
2323 a lease or rental agreement entered into or renewed on or after the
2424 effective date of this Act.
2525 SECTION 3. This Act takes effect September 1, 2023.
