9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 48.266(f), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (f) If the amount appropriated for the Foundation School |
---|
13 | 13 | | Program for the second year of a state fiscal biennium is less than |
---|
14 | 14 | | the amount to which school districts and open-enrollment charter |
---|
15 | 15 | | schools are entitled for that year, the commissioner shall certify |
---|
16 | 16 | | the amount of the difference to the Legislative Budget Board not |
---|
17 | 17 | | later than January 1 of the second year of the state fiscal |
---|
18 | 18 | | biennium. The Legislative Budget Board shall propose to the |
---|
19 | 19 | | legislature that the certified amount be transferred to the |
---|
20 | 20 | | foundation school fund from the economic stabilization fund and |
---|
21 | 21 | | appropriated for the purpose of increases in allocations under this |
---|
22 | 22 | | subsection. If the legislature fails during the regular session to |
---|
23 | 23 | | enact the proposed transfer and appropriation and there are not |
---|
24 | 24 | | funds available under Subsection (h), the commissioner may not |
---|
25 | 25 | | approve an expansion amendment for an open-enrollment charter |
---|
26 | 26 | | school or an application of a new charter holder for the biennium |
---|
27 | 27 | | before adjusting [shall adjust] the total amounts due to each |
---|
28 | 28 | | school district and open-enrollment charter school under this |
---|
29 | 29 | | chapter and the total amounts necessary for each school district to |
---|
30 | 30 | | comply with the requirements of Chapter 49 by an amount determined |
---|
31 | 31 | | by applying to each district and school the same percentage |
---|
32 | 32 | | adjustment to the total amount of state and local revenue due to the |
---|
33 | 33 | | district or school under this chapter and Chapter 49 so that the |
---|
34 | 34 | | total amount of the adjustment to all districts and schools results |
---|
35 | 35 | | in an amount equal to the total adjustment necessary. The following |
---|
36 | 36 | | fiscal year: |
---|
37 | 37 | | (1) a district's or school's entitlement under this |
---|
38 | 38 | | section is increased by an amount equal to the adjustment made |
---|
39 | 39 | | under this subsection; and |
---|
40 | 40 | | (2) the amount necessary for a district to comply with |
---|
41 | 41 | | the requirements of Chapter 49 is reduced by an amount necessary to |
---|
42 | 42 | | ensure a district's full recovery of the adjustment made under this |
---|
43 | 43 | | subsection. |
---|
44 | 44 | | SECTION 2. Section 48.269(a), Education Code, is amended to |
---|
45 | 45 | | read as follows: |
---|
46 | 46 | | (a) Not later than October 1 of each even-numbered year: |
---|
47 | 47 | | (1) the agency shall submit to the legislature: |
---|
48 | 48 | | (A) an estimate of the tax rate and student |
---|
49 | 49 | | enrollment of each school district for the following biennium; and |
---|
50 | 50 | | (B) for each open-enrollment charter school, the |
---|
51 | 51 | | school's student enrollment and the school's maximum enrollment |
---|
52 | 52 | | capacity; and |
---|
53 | 53 | | (2) the comptroller shall submit to the legislature an |
---|
54 | 54 | | estimate of the total taxable value of all property in the state as |
---|
55 | 55 | | determined under Subchapter M, Chapter 403, Government Code, for |
---|
56 | 56 | | the following biennium. |
---|
57 | 57 | | SECTION 3. This Act applies beginning with the 2023-2024 |
---|
58 | 58 | | school year. |
---|
59 | 59 | | SECTION 4. This Act takes effect immediately if it receives |
---|
60 | 60 | | a vote of two-thirds of all the members elected to each house, as |
---|
61 | 61 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
62 | 62 | | Act does not receive the vote necessary for immediate effect, this |
---|
63 | 63 | | Act takes effect September 1, 2023. |
