55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the port commission of the Port of
88 Corpus Christi Authority of Nueces County, Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 5016.0051, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 5016.0051. COMPOSITION OF PORT COMMISSION. The port
1313 commission is composed of nine [seven] port commissioners.
1414 SECTION 2. Section 5016.0052(a), Special District Local
1515 Laws Code, is amended to read as follows:
1616 (a) Port commissioners are appointed as follows:
1717 (1) the Commissioners Court of Nueces County shall
1818 appoint three port commissioners;
1919 (2) the city council of the City of Corpus Christi
2020 shall appoint three port commissioners; and
2121 (3) the Commissioners Court of San Patricio County
2222 shall appoint three [one] port commissioners [commissioner].
2323 SECTION 3. Not later than January 1, 2024, the
2424 Commissioners Court of San Patricio County shall appoint two port
2525 commissioners to the port commission of the Port of Corpus Christi
2626 Authority of Nueces County, Texas, as provided by Section
2727 5016.0052(a), Special District Local Laws Code, as amended by this
2828 Act, to serve terms that expire on dates that preserve the required
2929 staggering of terms.
3030 SECTION 4. (a) The legal notice of the intention to
3131 introduce this Act, setting forth the general substance of this
3232 Act, has been published as provided by law, and the notice and a
3333 copy of this Act have been furnished to all persons, agencies,
3434 officials, or entities to which they are required to be furnished
3535 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3636 Government Code.
3737 (b) The governor, one of the required recipients, has
3838 submitted the notice and Act to the Texas Commission on
3939 Environmental Quality.
4040 (c) The Texas Commission on Environmental Quality has filed
4141 its recommendations relating to this Act with the governor, the
4242 lieutenant governor, and the speaker of the house of
4343 representatives within the required time.
4444 (d) All requirements of the constitution and laws of this
4545 state and the rules and procedures of the legislature with respect
4646 to the notice, introduction, and passage of this Act are fulfilled
4747 and accomplished.
4848 SECTION 5. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2023.
