| 8 | 8 | | Corpus Christi Authority of Nueces County, Texas. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 5016.0051, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 5016.0051. COMPOSITION OF PORT COMMISSION. The port |
|---|
| 13 | 13 | | commission is composed of nine [seven] port commissioners. |
|---|
| 14 | 14 | | SECTION 2. Section 5016.0052(a), Special District Local |
|---|
| 15 | 15 | | Laws Code, is amended to read as follows: |
|---|
| 16 | 16 | | (a) Port commissioners are appointed as follows: |
|---|
| 17 | 17 | | (1) the Commissioners Court of Nueces County shall |
|---|
| 18 | 18 | | appoint three port commissioners; |
|---|
| 19 | 19 | | (2) the city council of the City of Corpus Christi |
|---|
| 20 | 20 | | shall appoint three port commissioners; and |
|---|
| 21 | 21 | | (3) the Commissioners Court of San Patricio County |
|---|
| 22 | 22 | | shall appoint three [one] port commissioners [commissioner]. |
|---|
| 23 | 23 | | SECTION 3. Not later than January 1, 2024, the |
|---|
| 24 | 24 | | Commissioners Court of San Patricio County shall appoint two port |
|---|
| 25 | 25 | | commissioners to the port commission of the Port of Corpus Christi |
|---|
| 26 | 26 | | Authority of Nueces County, Texas, as provided by Section |
|---|
| 27 | 27 | | 5016.0052(a), Special District Local Laws Code, as amended by this |
|---|
| 28 | 28 | | Act, to serve terms that expire on dates that preserve the required |
|---|
| 29 | 29 | | staggering of terms. |
|---|
| 30 | 30 | | SECTION 4. (a) The legal notice of the intention to |
|---|
| 31 | 31 | | introduce this Act, setting forth the general substance of this |
|---|
| 32 | 32 | | Act, has been published as provided by law, and the notice and a |
|---|
| 33 | 33 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 34 | 34 | | officials, or entities to which they are required to be furnished |
|---|
| 35 | 35 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 36 | 36 | | Government Code. |
|---|
| 37 | 37 | | (b) The governor, one of the required recipients, has |
|---|
| 38 | 38 | | submitted the notice and Act to the Texas Commission on |
|---|
| 39 | 39 | | Environmental Quality. |
|---|
| 40 | 40 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 41 | 41 | | its recommendations relating to this Act with the governor, the |
|---|
| 42 | 42 | | lieutenant governor, and the speaker of the house of |
|---|
| 43 | 43 | | representatives within the required time. |
|---|
| 44 | 44 | | (d) All requirements of the constitution and laws of this |
|---|
| 45 | 45 | | state and the rules and procedures of the legislature with respect |
|---|
| 46 | 46 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 47 | 47 | | and accomplished. |
|---|
| 48 | 48 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2023. |
