66 AN ACT
77 relating to the confidentiality of certain home address information
88 in property tax appraisal records.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.025(a), Tax Code, is amended to read
1111 as follows:
1212 (a) This section applies only to:
1313 (1) a current or former peace officer as defined by
1414 Article 2.12, Code of Criminal Procedure, and the spouse or
1515 surviving spouse of the peace officer;
1616 (2) the adult child of a current peace officer as
1717 defined by Article 2.12, Code of Criminal Procedure;
1818 (3) a current or honorably retired county jailer as
1919 defined by Section 1701.001, Occupations Code;
2020 (4) an employee of the Texas Department of Criminal
2121 Justice;
2222 (5) a commissioned security officer as defined by
2323 Section 1702.002, Occupations Code;
2424 (6) an individual who shows that the individual, the
2525 individual's child, or another person in the individual's household
2626 is a victim of family violence as defined by Section 71.004, Family
2727 Code, by providing:
2828 (A) a copy of a protective order issued under
2929 Chapter 85, Family Code, or a magistrate's order for emergency
3030 protection issued under Article 17.292, Code of Criminal Procedure;
3131 or
3232 (B) other independent documentary evidence
3333 necessary to show that the individual, the individual's child, or
3434 another person in the individual's household is a victim of family
3535 violence;
3636 (7) an individual who shows that the individual, the
3737 individual's child, or another person in the individual's household
3838 is a victim of sexual assault or abuse, stalking, or trafficking of
3939 persons by providing:
4040 (A) a copy of a protective order issued under
4141 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
4242 magistrate's order for emergency protection issued under Article
4343 17.292, Code of Criminal Procedure; or
4444 (B) other independent documentary evidence
4545 necessary to show that the individual, the individual's child, or
4646 another person in the individual's household is a victim of sexual
4747 assault or abuse, stalking, or trafficking of persons;
4848 (8) a participant in the address confidentiality
4949 program administered by the attorney general under Subchapter B,
5050 Chapter 58, Code of Criminal Procedure, who provides proof of
5151 certification under Article 58.059, Code of Criminal Procedure;
5252 (9) a federal judge, a federal bankruptcy judge, a
5353 marshal of the United States Marshals Service, a state judge, or a
5454 family member of a federal judge, a federal bankruptcy judge, a
5555 marshal of the United States Marshals Service, or a state judge;
5656 (10) a current or former district attorney, criminal
5757 district attorney, or county or municipal attorney whose
5858 jurisdiction includes any criminal law or child protective services
5959 matters;
6060 (11) a current or former employee of a district
6161 attorney, criminal district attorney, or county or municipal
6262 attorney whose jurisdiction includes any criminal law or child
6363 protective services matters;
6464 (12) an officer or employee of a community supervision
6565 and corrections department established under Chapter 76,
6666 Government Code, who performs a duty described by Section 76.004(b)
6767 of that code;
6868 (13) a criminal investigator of the United States as
6969 described by Article 2.122(a), Code of Criminal Procedure;
7070 (14) a current or honorably retired police officer or
7171 inspector of the United States Federal Protective Service;
7272 (15) a current or former United States attorney,
7373 assistant United States attorney, federal public defender, deputy
7474 federal public defender, or assistant federal public defender and
7575 the spouse and child of the attorney or public defender;
7676 (16) a current or former employee of the office of the
7777 attorney general who is or was assigned to a division of that office
7878 the duties of which involve law enforcement;
7979 (17) a medical examiner or person who performs
8080 forensic analysis or testing who is employed by this state or one or
8181 more political subdivisions of this state;
8282 (18) a current or former member of the United States
8383 armed forces who has served in an area that the president of the
8484 United States by executive order designates for purposes of 26
8585 U.S.C. Section 112 as an area in which armed forces of the United
8686 States are or have engaged in combat;
8787 (19) a current or former employee of the Texas
8888 Juvenile Justice Department or of the predecessors in function of
8989 the department;
9090 (20) a current or former juvenile probation or
9191 supervision officer certified by the Texas Juvenile Justice
9292 Department, or the predecessors in function of the department,
9393 under Title 12, Human Resources Code;
9494 (21) a current or former employee of a juvenile
9595 justice program or facility, as those terms are defined by Section
9696 261.405, Family Code;
9797 (22) a current or former employee of the Texas Civil
9898 Commitment Office or the predecessor in function of the office or a
9999 division of the office;
100100 (23) a current or former employee of a federal judge or
101101 state judge;
102102 (24) a current or former child protective services
103103 caseworker, adult protective services caseworker, or investigator
104104 for the Department of Family and Protective Services or a current or
105105 former employee of a department contractor performing child
106106 protective services caseworker, adult protective services
107107 caseworker, or investigator functions for the contractor on behalf
108108 of the department;
109109 (25) an elected public officer; [and]
110110 (26) a firefighter or volunteer firefighter or
111111 emergency medical services personnel as defined by Section 773.003,
112112 Health and Safety Code; and
113113 (27) an employee of a public defender's office as
114114 defined by Article 26.044(a), Code of Criminal Procedure.
115115 SECTION 2. This Act takes effect immediately if it receives
116116 a vote of two-thirds of all the members elected to each house, as
117117 provided by Section 39, Article III, Texas Constitution. If this
118118 Act does not receive the vote necessary for immediate effect, this
119119 Act takes effect September 1, 2023.
