55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the School Psychologists Shortage
88 Task Force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Commissioner" means the commissioner of
1212 education.
1313 (2) "Task force" means the School Psychologists
1414 Shortage Task Force established under Section 2 of this Act.
1515 SECTION 2. SCHOOL PSYCHOLOGISTS SHORTAGE TASK FORCE. (a)
1616 The commissioner shall establish the School Psychologists Shortage
1717 Task Force to study issues related to the shortage of school
1818 psychologists.
1919 (b) The members of the task force must include:
2020 (1) three members appointed by the lieutenant governor
2121 as follows:
2222 (A) two members of the senate; and
2323 (B) one licensed specialist in school
2424 psychology;
2525 (2) three members appointed by the speaker of the
2626 house of representatives as follows:
2727 (A) two members of the house of representatives;
2828 and
2929 (B) one licensed specialist in school
3030 psychology; and
3131 (3) one member of the State Board of Education
3232 appointed by the commissioner.
3333 (c) The Texas Education Agency shall provide administrative
3434 support to the task force.
3535 (d) The commissioner shall appoint a member of the task
3636 force to serve as the presiding officer.
3737 (e) The task force shall meet at the call of the presiding
3838 officer.
3939 (f) The task force shall:
4040 (1) conduct a study on the issues related to the
4141 shortage of school psychologists among school districts, including
4242 supply and demand issues for school-based psychological services
4343 among districts; and
4444 (2) provide recommendations for increasing the
4545 presence of school psychologists in school districts and increasing
4646 the use of school-based psychological services, as needed.
4747 SECTION 3. REPORT. Not later than December 31, 2024, the
4848 task force shall submit a report to the governor and the legislature
4949 that includes the task force's findings and recommendations under
5050 this Act.
5151 SECTION 4. ABOLITION OF TASK FORCE; EXPIRATION. The task
5252 force is abolished and this Act expires January 1, 2025.
5353 SECTION 5. EFFECTIVE DATE. This Act takes effect
5454 immediately if it receives a vote of two-thirds of all the members
5555 elected to each house, as provided by Section 39, Article III, Texas
5656 Constitution. If this Act does not receive the vote necessary for
5757 immediate effect, this Act takes effect September 1, 2023.
