| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 401.026, Labor Code, is amended to read |
|---|
| 10 | 10 | | as follows: |
|---|
| 11 | 11 | | Sec. 401.026. APPLICABILITY TO CERTAIN EMERGENCY RESPONSE |
|---|
| 12 | 12 | | PERSONNEL. For purposes of this subtitle, the travel of a |
|---|
| 13 | 13 | | firefighter, peace officer, or emergency medical personnel en route |
|---|
| 14 | 14 | | to an emergency call is considered to be in the course and scope of |
|---|
| 15 | 15 | | the firefighter's, peace officer's, or emergency medical |
|---|
| 16 | 16 | | personnel's employment. |
|---|
| 17 | 17 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 18 | 18 | | to a claim for workers' compensation benefits based on a |
|---|
| 19 | 19 | | compensable injury that occurs on or after the effective date of |
|---|
| 20 | 20 | | this Act. A claim based on a compensable injury that occurs before |
|---|
| 21 | 21 | | that date is governed by the law as it existed on the date the |
|---|
| 22 | 22 | | compensable injury occurred, and the former law is continued in |
|---|
| 23 | 23 | | effect for that purpose. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2023. |
