| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 102.052(a), Business & Commerce Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) A fee is imposed on a sexually oriented business in an |
|---|
| 13 | 13 | | amount equal to $10 [$5] for each entry by each customer admitted to |
|---|
| 14 | 14 | | the business. |
|---|
| 15 | 15 | | SECTION 2. Section 420.008(b), Government Code, is amended |
|---|
| 16 | 16 | | to read as follows: |
|---|
| 17 | 17 | | (b) The fund consists of: |
|---|
| 18 | 18 | | (1) fees and fines collected under: |
|---|
| 19 | 19 | | (A) Article 42A.653(a), Code of Criminal |
|---|
| 20 | 20 | | Procedure; |
|---|
| 21 | 21 | | (B) Section 508.189, Government Code; and |
|---|
| 22 | 22 | | (C) Subchapter B, Chapter 102, Business & |
|---|
| 23 | 23 | | Commerce Code, and deposited under Section 102.054 of that code; |
|---|
| 24 | 24 | | [and] |
|---|
| 25 | 25 | | (2) administrative penalties collected under Section |
|---|
| 26 | 26 | | 51.258, Education Code; and |
|---|
| 27 | 27 | | (3) amounts allocated under Section 183.054, Tax Code. |

| 28 | 28 | | SECTION 3. Section 183.023(b), Tax Code, is amended to read |
|---|
| 29 | 29 | | as follows: |
|---|
| 30 | 30 | | (b) Except for the amounts allocated under Subsection (c) of |
|---|
| 31 | 31 | | this section or Subchapter C of this chapter, the comptroller shall |
|---|
| 32 | 32 | | deposit the revenue received under this section in the general |
|---|
| 33 | 33 | | revenue fund. |
|---|
| 34 | 34 | | SECTION 4. Subchapter C, Chapter 183, Tax Code, is amended |
|---|
| 35 | 35 | | by adding Section 183.054 to read as follows: |
|---|
| 36 | 36 | | Sec. 183.054. ALLOCATION OF CERTAIN REVENUE TO SEXUAL |
|---|
| 37 | 37 | | ASSAULT PROGRAM FUND. The comptroller shall deposit an amount of |
|---|
| 38 | 38 | | money equal to one percent of the revenue received under |
|---|
| 39 | 39 | | Subchapters B and B-1 to the credit of the sexual assault program |
|---|
| 40 | 40 | | fund established under Section 420.008, Government Code. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2023. |
