| 7 | 7 | | relating to rating plan consequences for automobile insurance for |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1953.051(a), Insurance Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) A rating plan regarding the writing of automobile |
|---|
| 13 | 13 | | insurance [, other than insurance written under Chapter 2151,] may |
|---|
| 14 | 14 | | [not]: |
|---|
| 15 | 15 | | (1) assign a rate consequence to a charge or |
|---|
| 16 | 16 | | conviction for a violation of Subtitle C, Title 7, Transportation |
|---|
| 17 | 17 | | Code; or |
|---|
| 18 | 18 | | (2) otherwise cause premiums for automobile insurance |
|---|
| 19 | 19 | | to be increased because of a charge or conviction described by |
|---|
| 20 | 20 | | Subdivision (1). |

| 21 | 21 | | SECTION 2. Section 1953.051, Insurance Code, as amended by |
|---|
| 22 | 22 | | this Act, applies only to an insurance policy delivered, issued for |
|---|
| 23 | 23 | | delivery, or renewed on or after January 1, 2024. A policy |
|---|
| 24 | 24 | | delivered, issued for delivery, or renewed before January 1, 2024, |
|---|
| 25 | 25 | | is governed by the law as it existed immediately before the |
|---|
| 26 | 26 | | effective date of this Act, and that law is continued in effect for |
|---|
| 27 | 27 | | that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
