| 6 | 6 | | in-kind contributions, and expenditures made using a credit card. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter B, Chapter 254, Election Code, is |
|---|
| 9 | 9 | | amended by adding Section 254.044 to read as follows: |
|---|
| 10 | 10 | | Sec. 254.044. REPORTING OF POLITICAL CONTRIBUTIONS AND |
|---|
| 11 | 11 | | EXPENDITURES MADE USING CREDIT CARD. (a) A candidate or |
|---|
| 12 | 12 | | officeholder who accepts a political contribution made using a |
|---|
| 13 | 13 | | credit card shall: |
|---|
| 14 | 14 | | (1) for a political contribution for which a |
|---|
| 15 | 15 | | processing fee is deducted by the credit card issuer from the |
|---|
| 16 | 16 | | political contribution amount: |
|---|
| 17 | 17 | | (A) report as a political contribution the full |
|---|
| 18 | 18 | | amount, including the deducted amount; and |
|---|
| 19 | 19 | | (B) report as a political expenditure the |
|---|
| 20 | 20 | | deducted amount; and |
|---|
| 21 | 21 | | (2) for a political contribution for which a |
|---|
| 22 | 22 | | processing fee is paid by the person making the political |
|---|
| 23 | 23 | | contribution in excess of the political contribution amount, report |
|---|
| 24 | 24 | | only as a political contribution the full amount the candidate or |
|---|
| 25 | 25 | | officeholder accepts, not including the amount paid in excess of |
|---|
| 26 | 26 | | the political contribution amount. |
|---|
| 27 | 27 | | (b) A candidate or officeholder who accepts a political |
|---|
| 28 | 28 | | contribution described by Subsection (a)(2) is not required to |
|---|
| 29 | 29 | | report the excess amount paid as a processing fee by the person |
|---|
| 30 | 30 | | making the political contribution. |
|---|
| 31 | 31 | | SECTION 2. Section 254.044, Election Code, as added by this |
|---|
| 32 | 32 | | Act, applies only to a report of political contributions and |
|---|
| 33 | 33 | | expenditures under Chapter 254, Election Code, that is required to |
|---|
| 34 | 34 | | be filed on or after January 1, 2024. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
