55 relating to the reporting of political contributions, including
66 in-kind contributions, and expenditures made using a credit card.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 254, Election Code, is
99 amended by adding Section 254.044 to read as follows:
1010 Sec. 254.044. REPORTING OF POLITICAL CONTRIBUTIONS AND
1111 EXPENDITURES MADE USING CREDIT CARD. (a) A candidate or
1212 officeholder who accepts a political contribution made using a
1313 credit card shall:
1414 (1) for a political contribution for which a
1515 processing fee is deducted by the credit card issuer from the
1616 political contribution amount:
1717 (A) report as a political contribution the full
1818 amount, including the deducted amount; and
1919 (B) report as a political expenditure the
2020 deducted amount; and
2121 (2) for a political contribution for which a
2222 processing fee is paid by the person making the political
2323 contribution in excess of the political contribution amount, report
2424 only as a political contribution the full amount the candidate or
2525 officeholder accepts, not including the amount paid in excess of
2626 the political contribution amount.
2727 (b) A candidate or officeholder who accepts a political
2828 contribution described by Subsection (a)(2) is not required to
2929 report the excess amount paid as a processing fee by the person
3030 making the political contribution.
3131 SECTION 2. Section 254.044, Election Code, as added by this
3232 Act, applies only to a report of political contributions and
3333 expenditures under Chapter 254, Election Code, that is required to
3434 be filed on or after January 1, 2024.
3535 SECTION 3. This Act takes effect September 1, 2023.
