7	7	relating to the eligibility of certain municipalities to establish
8	8	homestead preservation districts and reinvestment zones and to
9	9	certain regulatory prohibitions applicable in those districts and
10	10	zones.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 214.905, Local Government Code, is
13	13	amended by adding Subsection (b-1) to read as follows:
14	14	(b-1) Subsection (b)(2) does not apply to a municipality
15	15	described by Section 373A.003(a)(2) in relation to a requirement
16	16	described by Subsection (a) that is proposed for an area served
17	17	under the provisions of Chapter 373A.
18	18	SECTION 2. Section 373A.002, Local Government Code, is
19	19	amended by amending Subdivision (3-a) and adding Subdivision (3-b)
20	20	to read as follows:
21	21	(3-a) "Low income household" means a household with a
22	22	gross income of not greater than 80 percent of the area median
23	23	family income, adjusted for household size, for the metropolitan
24	24	statistical area in which the municipality is located, as
25	25	determined annually by the United States Department of Housing and
26	26	Urban Development.
27	27	(3-b) "Project costs" has the meaning assigned by
28	28	Section 311.002(1), Tax Code.
29	29	SECTION 3. Section 373A.003(a), Local Government Code, is
30	30	amended to read as follows:
31	31	(a) This chapter applies to:
32	32	(1) a municipality with a population of more than
33	33	750,000 that is located in a uniform state service region with fewer
34	34	than 550,000 occupied housing units as determined by the most
35	35	recent United States decennial census; and
36	36	(2) a municipality with a population of two million or
37	37	more.
38	38	SECTION 4. Section 373A.052, Local Government Code, is
39	39	amended by amending Subsection (a) and adding Subsection (a-1) to
40	40	read as follows:
41	41	(a) To be designated as a district within a municipality
42	42	described by Section 373A.003(a)(1) [373A.003(a)] under this
43	43	subchapter, an area must be composed of census tracts forming a
44	44	spatially compact area with:
45	45	(1) fewer than 75,000 residents;
46	46	(2) an overall poverty rate that is at least two times
47	47	the poverty rate for the entire municipality; and
48	48	(3) in each census tract within the area, a median
49	49	family income that is less than 80 percent of the median family
50	50	income for the entire municipality.
51	51	(a-1) To be designated as a district within a municipality
52	52	described by Section 373A.003(a)(2) under this subchapter:
53	53	(1) an area must be composed of census tracts forming a
54	54	spatially compact area; and
55	55	(2) the governing body of the municipality must make
56	56	findings by resolution that:
57	57	(A) the area will benefit from the inclusion of
58	58	low income households;
59	59	(B) low-income and moderate-income homeowners
60	60	within the area are at risk of losing their homesteads through
61	61	displacement; and
62	62	(C) the designation will serve one or more
63	63	purposes outlined by this chapter.
64	64	SECTION 5. Section 373A.203(6), Local Government Code, is
65	65	repealed.
66	66	SECTION 6. This Act takes effect September 1, 2023.
