77 relating to court administration for cases referred to criminal law
88 magistrates in Tarrant County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 54, Government Code, is
1111 amended by adding Section 54.6585 to read as follows:
1212 Sec. 54.6585. CLERK. (a) The district clerk serves as
1313 clerk of the cases referred to a magistrate under this subchapter,
1414 except:
1515 (1) the county clerk serves as clerk for a Class A or
1616 Class B misdemeanor case filed in a county criminal court and
1717 referred to a magistrate; and
1818 (2) the originating justice court clerk serves as
1919 clerk for a Class C misdemeanor case filed in a justice court and
2020 referred to a magistrate.
2121 (b) The district clerk shall establish a docket and keep the
2222 minutes for the cases referred to a magistrate under this
2323 subchapter. To facilitate the duties associated with serving as
2424 the clerk for the cases referred to a magistrate, the district clerk
2525 and deputy district clerks may serve as deputy county clerks and
2626 deputy justice clerks at the discretion of the district clerk.
2727 SECTION 2. This Act takes effect September 1, 2023.
