| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 54, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 54.6585 to read as follows: |
|---|
| 12 | 12 | | Sec. 54.6585. CLERK. (a) The district clerk serves as |
|---|
| 13 | 13 | | clerk of the cases referred to a magistrate under this subchapter, |
|---|
| 14 | 14 | | except: |
|---|
| 15 | 15 | | (1) the county clerk serves as clerk for a Class A or |
|---|
| 16 | 16 | | Class B misdemeanor case filed in a county criminal court and |
|---|
| 17 | 17 | | referred to a magistrate; and |
|---|
| 18 | 18 | | (2) the originating justice court clerk serves as |
|---|
| 19 | 19 | | clerk for a Class C misdemeanor case filed in a justice court and |
|---|
| 20 | 20 | | referred to a magistrate. |
|---|
| 21 | 21 | | (b) The district clerk shall establish a docket and keep the |
|---|
| 22 | 22 | | minutes for the cases referred to a magistrate under this |
|---|
| 23 | 23 | | subchapter. To facilitate the duties associated with serving as |
|---|
| 24 | 24 | | the clerk for the cases referred to a magistrate, the district clerk |
|---|
| 25 | 25 | | and deputy district clerks may serve as deputy county clerks and |
|---|
| 26 | 26 | | deputy justice clerks at the discretion of the district clerk. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
