| 7 | 7 | | relating to the regulation of veterinary chiropractic. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 9 | 9 | | SECTION 1. Section 801.151(c), Occupations Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (c) The board shall adopt rules to: |
|---|
| 12 | 12 | | (1) protect the public; |
|---|
| 13 | 13 | | (2) ensure that alternate therapies, including |
|---|
| 14 | 14 | | ultrasound diagnosis and therapy, magnetic field therapy, holistic |
|---|
| 15 | 15 | | medicine, homeopathy, [chiropractic treatment,] acupuncture, and |
|---|
| 16 | 16 | | laser therapy, are performed only by a veterinarian or under the |
|---|
| 17 | 17 | | supervision of a veterinarian; |
|---|
| 18 | 18 | | (3) ensure that equine dentistry is performed only by |
|---|
| 19 | 19 | | a veterinarian who is active and in good standing or by a licensed |
|---|
| 20 | 20 | | equine dental provider who is active and in good standing under the |
|---|
| 21 | 21 | | appropriate level of supervision of a veterinarian who is active |
|---|
| 22 | 22 | | and in good standing and who has established a |
|---|
| 23 | 23 | | veterinarian-client-patient relationship with the owner or other |
|---|
| 24 | 24 | | caretaker of an animal in accordance with Section 801.351; [and] |
|---|
| 25 | 25 | | (4) ensure that chiropractic treatment and |
|---|
| 26 | 26 | | musculoskeletal manipulation are performed only by: |
|---|
| 27 | 27 | | (A) a veterinarian who is active and in good |
|---|
| 28 | 28 | | standing; or |
|---|
| 29 | 29 | | (B) a chiropractor licensed in good standing |
|---|
| 30 | 30 | | under Chapter 201 and who is: |
|---|
| 31 | 31 | | (i) certified in good standing by the |
|---|
| 32 | 32 | | American Veterinary Chiropractic Association; or |
|---|
| 33 | 33 | | (ii) acting under the supervision of a |
|---|
| 34 | 34 | | veterinarian; and |
|---|
| 35 | 35 | | (5) provide for the licensing and regulation of |
|---|
| 36 | 36 | | licensed veterinary technicians. |
|---|
| 37 | 37 | | SECTION 2. Not later than June 1, 2024, the State Board of |
|---|
| 38 | 38 | | Veterinary Medical Examiners shall adopt rules necessary to |
|---|
| 39 | 39 | | implement Section 801.151(c), Occupations Code, as amended by this |
|---|
| 40 | 40 | | Act. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2023. |
