66 AN ACT
77 relating to governmental contracts with companies that engage in
88 certain economic boycotts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2274, Government Code, as added by
1111 Chapter 529 (S.B. 13), Acts of the 87th Legislature, Regular
1212 Session, 2021, is amended to read as follows:
1313 CHAPTER 2274. PROHIBITION ON CONTRACTS WITH COMPANIES ENGAGING IN
1414 CERTAIN ECONOMIC BOYCOTTS [BOYCOTTING CERTAIN ENERGY COMPANIES]
1515 Sec. 2274.001. DEFINITIONS. In this chapter:
1616 (1) ["Boycott energy company" has the meaning assigned
1717 by Section 809.001.]
1818 [(2)] "Company" has the meaning assigned by Section
1919 809.001, except that the term does not include a sole
2020 proprietorship.
2121 (2) "Economic boycott" means, without an ordinary
2222 business purpose, refusing to deal with, terminating business
2323 activities with, or otherwise taking any action that is intended to
2424 penalize, inflict economic harm on, limit commercial relations
2525 with, or limit the activities of a company because the company,
2626 without violating a federal or state law:
2727 (A) engages in the exploration, production,
2828 utilization, transportation, sale, or manufacturing of fossil
2929 fuel-based energy, timber, mining, or agriculture and does not
3030 commit or pledge to meet environmental standards beyond applicable
3131 federal and state law;
3232 (B) does not meet, is not expected to meet, or
3333 does not commit to meeting:
3434 (i) environmental standards or disclosure
3535 criteria, including disclosure criteria relating to the
3636 elimination, reduction, or offsetting of greenhouse gas emissions;
3737 or
3838 (ii) corporate board, employee
3939 composition, compensation, or disclosure criteria that
4040 incorporates diversity, equity, and inclusion standards; or
4141 (C) does business with a company described by
4242 Paragraph (A) or (B).
4343 (3) "Governmental entity" has the meaning assigned by
4444 Section 2251.001.
4545 Sec. 2274.002. PROVISION REQUIRED IN CONTRACT. (a) This
4646 section applies only to a contract that:
4747 (1) is between a governmental entity and a company
4848 with 10 or more full-time employees; and
4949 (2) has a value of $100,000 or more that is to be paid
5050 wholly or partly from public funds of the governmental entity.
5151 (b) Except as provided by Subsection (c), a governmental
5252 entity may not enter into a contract with a company for goods or
5353 services unless the contract contains a written verification from
5454 the company that it:
5555 (1) does not engage in an economic boycott [energy
5656 companies]; and
5757 (2) will not engage in an economic boycott [energy
5858 companies] during the term of the contract.
5959 (c) Subsection (b) does not apply to a governmental entity
6060 that determines the requirements of Subsection (b):
6161 (1) are inconsistent with the governmental entity's
6262 constitutional or statutory duties related to the issuance,
6363 incurrence, or management of debt obligations or the deposit,
6464 custody, management, borrowing, or investment of funds; or
6565 (2) prevent the governmental entity from obtaining
6666 necessary goods and services in an economically practical manner.
6767 SECTION 2. The changes in law made by this Act apply only to
6868 a contract entered into on or after the effective date of this Act.
6969 A contract entered into before that date is governed by the law in
7070 effect on the date the contract was entered into, and the former law
7171 is continued in effect for that purpose.
7272 SECTION 3. This Act takes effect September 1, 2023.
