55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of air quality permits for certain
88 facilities located in a nonattainment area.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 382.0518, Health and Safety Code, is
1111 amended by adding Subsections (b-1) and (b-2) to read as follows:
1212 (b-1) This subsection applies only to the construction or
1313 major modification of a facility that is a major stationary source
1414 and is located or proposed to be located in an area designated as a
1515 nonattainment area under the federal Clean Air Act (42 U.S.C.
1616 Section 7401 et seq.). In making its finding under Subsection
1717 (b)(2) as to whether emissions from the facility will contravene
1818 the intent of this chapter, the commission shall:
1919 (1) conduct an analysis of alternative locations,
2020 sizes, production processes, and environmental control techniques
2121 for the facility that demonstrates that the benefits of the
2222 facility significantly outweigh the environmental and social costs
2323 imposed as a result of the facility's location, construction, or
2424 modification; and
2525 (2) in conducting the analysis required under
2626 Subdivision (1), consider the cumulative impacts that would result
2727 from the issuance of the permit without changes to the site
2828 location, size, production processes, and environmental control
2929 techniques.
3030 (b-2) For purposes of Subsection (b-1), "major stationary
3131 source" and "major modification" have the meanings assigned by 40
3232 C.F.R. Section 51.165, as that section existed on January 1, 2023.
3333 SECTION 2. The change in law made by this Act applies only
3434 to the issuance or amendment of a permit for which an application is
3535 pending before the Texas Commission on Environmental Quality on or
3636 after the effective date of this Act.
3737 SECTION 3. This Act takes effect September 1, 2023.
