10	10	AN ACT
11	11	relating to adding a designation on a person's driver's license or
12	12	commercial driver's license indicating that the person is licensed
13	13	to carry a handgun.
14	14	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	15	SECTION 1. Section 507.001(b), Business & Commerce Code, is
16	16	amended to read as follows:
17	17	(b) This section does not affect:
18	18	(1) the requirement to display a handgun license under
19	19	Section 411.205, Government Code[, that a person subject to that
20	20	section present a driver's license or identification certificate in
21	21	addition to a concealed handgun license]; or
22	22	(2) the types of identification required under federal
23	23	law to access airport premises or pass through airport security.
24	24	SECTION 2. Subchapter H, Chapter 411, Government Code, is
25	25	amended by adding Section 411.1795 to read as follows:
26	26	Sec. 411.1795. DESIGNATION ON DRIVER'S LICENSE OR
27	27	COMMERCIAL DRIVER'S LICENSE. The department shall adopt rules
28	28	allowing an applicant for an original, duplicate, modified, or
29	29	renewed license under this subchapter, in addition to being issued
30	30	an original, duplicate, modified, or renewed license, to elect to
31	31	include on the person's driver's license or commercial driver's
32	32	license a designation indicating that the person is licensed under
33	33	this subchapter. The rules must include procedures to ensure that a
34	34	person who makes an election under this section:
35	35	(1) receives a designation on the person's driver's
36	36	license or commercial driver's license only if the person meets the
37	37	requirements for issuance of the original, duplicate, modified, or
38	38	renewed handgun license; and
39	39	(2) maintains the designation only during the period
40	40	for which the person is licensed to carry a handgun under this
41	41	subchapter.
42	42	SECTION 3. Section 411.205, Government Code, is amended to
43	43	read as follows:
44	44	Sec. 411.205. REQUIREMENT TO DISPLAY LICENSE. If a license
45	45	holder is carrying a handgun on or about the license holder's person
46	46	when a magistrate or a peace officer demands that the license holder
47	47	display identification, the license holder shall display:
48	48	(1) either of the following:
49	49	(A) the license holder's driver's license or
50	50	commercial driver's license that includes a handgun license
51	51	designation under Section 521.128 or 522.030, Transportation Code;
52	52	or
53	53	(B) both the license holder's driver's license,
54	54	commercial driver's license, or personal identification
55	55	certificate issued by the department and the license holder's
56	56	handgun license; and
57	57	(2) if the license holder's handgun license bears a
58	58	protective order designation, a copy of the applicable court order
59	59	under which the license holder is protected.
60	60	SECTION 4. Subchapter F, Chapter 521, Transportation Code,
61	61	is amended by adding Section 521.128 to read as follows:
62	62	Sec. 521.128. HANDGUN LICENSE DESIGNATION. The department
63	63	shall include on each driver's license issued to a person licensed
64	64	to carry a handgun under Subchapter H, Chapter 411, Government
65	65	Code, who makes an election under Section 411.1795, Government
66	66	Code, a designation that shows the person is licensed under that
67	67	subchapter. The designation must include the person's handgun
68	68	license number and a statement of the period for which the handgun
69	69	license is effective.
70	70	SECTION 5. Section 522.030, Transportation Code, is amended
71	71	by adding Subsection (e) to read as follows:
72	72	(e) The department shall include on each commercial
73	73	driver's license issued to a person licensed to carry a handgun
74	74	under Subchapter H, Chapter 411, Government Code, who makes an
75	75	election under Section 411.1795, Government Code, a designation
76	76	that shows the person is licensed under that subchapter. The
77	77	designation must include the person's handgun license number and a
78	78	statement of the period for which the handgun license is effective.
79	79	SECTION 6. Not later than December 1, 2023, the Department
80	80	of Public Safety shall adopt the rules required by Section
81	81	411.1795, Government Code, as added by this Act.
82	82	SECTION 7. (a) Section 411.1795, Government Code, as added
83	83	by this Act, applies only to an applicant for an original,
84	84	duplicate, modified, or renewed license to carry a handgun under
85	85	Subchapter H, Chapter 411, Government Code, as amended by this Act,
86	86	who submits the application on or after January 1, 2024.
87	87	(b) The changes in law made by this Act to Chapters 521 and
88	88	522, Transportation Code, apply only to a driver's license or
89	89	commercial driver's license issued or renewed under Chapter 521 or
90	90	522, Transportation Code, on or after January 1, 2024.
91	91	SECTION 8. This Act takes effect September 1, 2023.
