| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 201.105, Transportation Code, is amended |
|---|
| 9 | 9 | | by adding Subsection (h) to read as follows: |
|---|
| 10 | 10 | | (h) The commission by rule shall prescribe criteria for the |
|---|
| 11 | 11 | | classification of each district as metropolitan, urban, or rural. |
|---|
| 12 | 12 | | The rules must classify a district with a population of more than |
|---|
| 13 | 13 | | one million as metropolitan. |
|---|
| 14 | 14 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 15 | 15 | | of this Act, the Texas Transportation Commission shall adopt the |
|---|
| 16 | 16 | | rules required by Section 201.105(h), Transportation Code, as added |
|---|
| 17 | 17 | | by this Act. |
|---|
| 18 | 18 | | SECTION 3. This Act takes effect September 1, 2023. |
