| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 352.012, Local Government Code, is | |
| 11 | 11 | amended by adding Subsection (c) to read as follows: | |
| 12 | 12 | (c) A county that has adopted a fire code under Subchapter | |
| 13 | 13 | C, Chapter 233, may require that the county fire marshal be | |
| 14 | 14 | certified by the Texas Commission on Fire Protection as head of a | |
| 15 | 15 | prevention-only fire department. | |
| 16 | 16 | SECTION 2. The change in law made by this Act applies only | |
| 17 | 17 | to a fire marshal commissioned by a county on or after the effective | |
| 18 | 18 | date of this Act. | |
| 19 | 19 | SECTION 3. This Act takes effect September 1, 2023. |
