7 | 7 | | relating to weight limitations for hydrogen fueled motor vehicles. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 621.101(b-1), Transportation Code, is |
---|
10 | 10 | | amended to read as follows: |
---|
11 | 11 | | (b-1) Notwithstanding any other provision of this section, |
---|
12 | 12 | | a vehicle or combination of vehicles that is powered by an engine |
---|
13 | 13 | | fueled primarily by natural gas or hydrogen may exceed any weight |
---|
14 | 14 | | limitation under this section by an amount that is equal to the |
---|
15 | 15 | | difference between the weight of the vehicle attributable to the |
---|
16 | 16 | | natural gas or hydrogen tank and fueling system carried by that |
---|
17 | 17 | | vehicle and the weight of a comparable diesel tank and fueling |
---|
18 | 18 | | system, provided that the maximum gross weight of the vehicle or |
---|
19 | 19 | | combination of vehicles may not exceed 82,000 pounds. |
---|
20 | 20 | | SECTION 2. (a) Except as otherwise provided by this |
---|
21 | 21 | | section, this Act takes effect September 1, 2023. |
---|
22 | 22 | | (b) This Act takes effect only if the United States Congress |
---|
23 | 23 | | enacts legislation or a federal agency adopts a regulation that |
---|
24 | 24 | | becomes law authorizing a vehicle that is powered by an engine |
---|
25 | 25 | | fueled primarily by hydrogen to be operated on a federal interstate |
---|
26 | 26 | | or highway at a weight that exceeds a weight limitation established |
---|
27 | 27 | | by federal law. If the United States Congress or a federal agency |
---|
28 | 28 | | does not enact legislation or adopt a regulation that becomes law |
---|
29 | 29 | | described by this subsection, this Act has no effect. |
