66 AN ACT
77 relating to weight limitations for hydrogen fueled motor vehicles.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 621.101(b-1), Transportation Code, is
1010 amended to read as follows:
1111 (b-1) Notwithstanding any other provision of this section,
1212 a vehicle or combination of vehicles that is powered by an engine
1313 fueled primarily by natural gas or hydrogen may exceed any weight
1414 limitation under this section by an amount that is equal to the
1515 difference between the weight of the vehicle attributable to the
1616 natural gas or hydrogen tank and fueling system carried by that
1717 vehicle and the weight of a comparable diesel tank and fueling
1818 system, provided that the maximum gross weight of the vehicle or
1919 combination of vehicles may not exceed 82,000 pounds.
2020 SECTION 2. (a) Except as otherwise provided by this
2121 section, this Act takes effect September 1, 2023.
2222 (b) This Act takes effect only if the United States Congress
2323 enacts legislation or a federal agency adopts a regulation that
2424 becomes law authorizing a vehicle that is powered by an engine
2525 fueled primarily by hydrogen to be operated on a federal interstate
2626 or highway at a weight that exceeds a weight limitation established
2727 by federal law. If the United States Congress or a federal agency
2828 does not enact legislation or adopt a regulation that becomes law
2929 described by this subsection, this Act has no effect.
